RESOLUTION N0.95 -688
AUTHORIZING THE APPLICATION OF
FUTURE SPECIAL ASSESSMENTS TOWARD
THE PURCHASE OF THE NECESSARY EASIIID'MS FOR
CITY PROJECT NO'S 502 AND 503
WHEREAS, the City has reached a tentative agreement with Mr. Gary P. Leuer and Mr.
Jerome A. Leuer representing the Leuer family for the purchase of the necessary right-of-
way and easements for City Project No's 502 and 503; and
WHEREAS, the Leuers have requested that the City pay the future special assessments
that will be levied against their property for sewer and water area and curb and gutter
assessments (now pending against their property in the amount of $55,737.82) as payment
for the permanent and temporary right-of-way and utility easements; and
WHEREAS, it is considered mutually beneficial to the City and to the Leuers to do so.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That it should and hereby does authorize the
payment of fixture special assessments when levied for Project No's 502 and 503 (now
pending against the Leuer property) as payment for the right-of-way and easements needed
for these projects. Said payment shall be from the Project Budget for right-of-way.
