HomeMy WebLinkAboutCity Council Resolution 1995-677CITY OF PLYMOUTH RESOLUTION 95 -677 APPROVING AMENDED RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN AND CONDITIONAL USE PERMIT FOR LDK BUILDERS, INC. FOR BLOCK 2, FRENCH RIDGE PARK ADDITION (RPUD 95-2) (95108) WHEREAS, LDK Builders, Inc. has requested an Amended Planned Unit Development Plan and Conditional Use Permit to allow the construction of a townhome development with a 16 -foot setback between certain buildings, rather than 20 feet as originally approved under the RPUD; WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does appro%4 the request of LDK Builders, Inc, for an Amended Planned Unit Development Plan and Conditional Use Permit to allow a four foot reduction in the setback between certain buildings, from 20 feet to 16 feet, subject to the following conditions: 1. T.ds Amended PUD Plan and Conditional Use Permit allows the construction of a townhome development with a minimum setback of 16 feet between certain buildings, in accordance wirb the application and plans received by the City on September 22, 1995, except as amended by this resolution. 2. The 16 -foot minimum setback would apply to the building setbacks between Lots : & 3, 8 & 9, 10 & 11, 12 & 13, and 16 & 17, all in Block 2, French iUdh4 Park Addition. 3. No encroachment shall be permitted on the 20 -toot wide drainage and utility casement located between Lots 14 & 15 and Lots 18 & 19, Block 2, French Ridge Park Addition, 4. Compliance with all applicable requirements of the City and State Building Codes, 5. No other amendments or variations are granted or Implied. Adopted by the City Council on November 14, 1995.
