RESOLUTION NO. 95 - 650
APPROVE REEMURSEMENT AGREEMENT WITH
SPRINT COMMUNICATIONS COMPANY L.P. FOR'THE
CONSTRUCTION OF PEONY LANE
CITY PROJECT NO. 502
WHEREAS, the City Council has recently approved a contract for the construction of
Peony Lane; and
WHEREAS, the proposed bridge structure and embankment crosses the Soo Line railroad
right-of-way; and
WHEREAS, Sprint Communications Compan.: L.P. has an existing fiber optics cable
within the railroad right-of-way passing under existing Peony lane; and
WHEREAS, the existing fiber optics cable will need to be protected from the bridge
embankment fill placed within the railroad right-of-way over the existing fiber optics
cable; and
WHEREAS, Sprint Communications Company L.P. has an easement with the railroad
company indicating .any subsequent occupancies of the railroad right-of-way shall not
interfere v .th U.S. Sprint's use; and
WHEREAS, a reimbursement agreement is required with Sprint Communications
Company, L.P. for chem to do the necessary work to protect their existing fiber optics
cable from the Peony Lane bridge embanknâ–ºent fill material.
NOW, THEREFORE, BE IT RE MY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA. That the Mayor and City Manager ars
authorized to execute the reimbursement agreement as precured by Sprint Communications
Company L.P. for the protection of their existing fiber optics cable from potential damage
due to the Peony Lane bridge overpass.
