RESOLUTION No. 9S- 639
REDUCING REQUIRED FINANCIAL GUARANTEE
HEATHER RUN 2ND ADDITION (94016)
WHEREAS, in accordance with the development contract dated March 40 1994, Lundgren Bros.
Construction, Inc., developer of Heather Run 2nd Addition (94016), has agreed to install certain
improvements for said development; and
WHEREAS, the developer has completed a portion of the street, utility and site grading as noted below;
and
WHEREAS, the developer has requested a reduction of the required fuiancial guarantee to rflect the
completed work;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA; that the financial guarantee requirements are reduced as follows:

Sanitary Sewer
Watermain
Storm Sewer
Boulevard and Drainage Swale Sod
Mitigation Pond Construction
Sediment Pond Construction
Street Signs (1 x 200)
Parking Lot for Park
Site Grading and Drainage Improvements

Setting Iron Monuments
Design, Administration, lnspectlon, As-Builts

That the required financial guarantee for the above items be reduced as detailed above from $39,200 to
$25240 to reflect the completed work. Letter of Credit No. 28466-D may be reduced accordingly.

FURTHER BE IT RESOLVED that the street construction and concrete curb and gutter is accepted for
continual maintenance as of October 24, 1995 subject to the Two Year Guarantee by the Developer per
Maintenance Bond No. 54070056.
