REDUCING SITE 04PROVEMENT PERFORMANCE GUARANTEE
CARLSON REAL ESTATE COMPANY /FORMER J.C. PENNY BUILDING

WHEREAS, in accordance with the Site Plan Amendment that was Administratively
approved on November 21, 1994, for Carlson Real Estate Company developer of
former J.C. Penny building (94147.t, has agreed to install certain site improvements bar
said development; and
WHEREAS, the developer has completed a majority of the site improvements except:
Winter survivability of said landscaping and submittal of As -Built utility plans to the
Engineering department.
WHEREAS, upon notice from th.- developer, City staff has inspected said site and
recommends a release of the financial guarantee to reflect tae completed work;
NOW, THEREFORE, BE IT HE;4EBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does authorize
a $333,955.00 reduction of the Utter of Credit which was submitted to guan7kre site
improvements for the former J. C Penny building to a new financial guarantee total of
54,000.00.
