HomeMy WebLinkAboutCity Council Resolution 1995-611CITY OF PLYMOUTH RESOLUTION 95 -611 • 1 Ca iu ea a .: :�• �: •] z 101 V • r NMI. -• • • �• -• :� �a • u 1: • i •• ••a • :n •�- WHEREAS, Carlson Real Estate Company has requested a Preliminary Plat, General Development Plan, Site Plan, Conditional Use Permit and Variance for a Super America convenience store and Class II restaurant located at the southeast coiner of I- 494 and County Road 6. The property is more specifically described as follows: Lots 1, 2, and 3, Block 1 Litton Addition, and the east 200 feet of the west 350 feet of the north 200 feet of the Bast 1/2 of the Southeast Quarter of the Southwest Quarter, Section 27, Township 118, Range 22, Hennepin County, Minnesota. K WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Carlson Real Estate Company for a Preliminary Plat, General Development Plan, Site Plan and Conditional Use Permit and Variance for a Super America convenience store and Class lI restaurant located at the southeast corner of I- 494 and County Road 6, subject to the following conditions: 1. Preliminary Plat approval is granted ;or the creation of three new lots and the reconfiguration of one existing lot as shown on the plans for Minneapolis Industrial Park 6th Addition received by the City on September 20, 1995. 2. A Variance is granted for the construction of two structures on one lot (Lot 4 Block I Minneapolis Industrial Park 6th Addition) based on the finding that: A. the hardship is due to the Zoning Ordinance and conflicting ,requirements of the Uniform Building Code B. the Variance would not impair the supply of light and air to the surrounding properties C. the Variance would not impair property values in the area. 94014 Page 2 3. A Conditional Use Permit, Site Plan and Variance is granted for the construction of a 3,500 square foot Super America Convenience store with an attached 865 square foot drive through car wash and a detached gas pump canopy as shown on the plans received by the City on September 20, 1995. 4. A Conditional Use Permit and Site Plan is granted for the construction of a 3,500 square foot Class II restaurant with a seating capacity of 80 as shown on the plans received by the City on September 20, 1995. 5. Park dedication requirements shall be a combination of. A fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of building permit issuance B dedication of a trail easement C trail construction 6. The applicant shall be reimbursed for the construct an eight -foot bituminous trail along the south side of Co. Rd. 6. Base trail construction shall be the responsibility of the developer. 7. The Site Plan for thn Super America shall include a 10 -foot setback from the drive aisle to the car wash building. 8. On-site traffic control signage shall identify the fust entrance off of tfe private drive for access to the gas station and notice of the fast food restaurant at the next on-site entrance. 9. A median shall be added at the entrance of thin site to prevent left turning movements from the Super America site onto the private north/south driveway. 10. Pylon signage dire: ted towards traffic on 1-494 shall be prohibited. 11. The adverstising sign located in Lot 1 shall be removed prior to issuance of building permits for Lots 3 or 4. 12. Standard Conditions; A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to. or containing any open storm water drainage facility. C. Submission of the required Financial Guaram.ee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 94014 Page 3 B. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. F. An 81/2 x 11 inch "As Built" Fire Prutection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Submission and approval of fire flow calculations prior to the issuance of building permits. H. The permit is subject to all applicable codes, regulations and ordinances, and viulation thereof shall be grounds for revocation. I. Any signage shall be in compliance with the Ordinance. J. All waste and waste containers shall be stored within the enclosure structures. K. No building permit to be issued until the Final Plat is filed and recorded with Hennepin County.
