HomeMy WebLinkAboutCity Council Resolution 1995-6099 CITY OF PLYMOUTH RESOLUTION 95- 609 RESOLUTION GRANTING A VARIANCE FROM THE PROVISIONS OF SECTION 500 OF THE PLYMOUTH CITY CODE, SUBDMSION AND PLATTING OF LAND (95103) BE IT RESOLVED by the City Council of the City of Plymouth as follows: WHEREAS, in conjunction with City Project No. 5-11, the City has entered into Purchase Agreements with Nancy Chalmers Hardenbergh and her children to purchase 17 acres of property owned by Mrs. Hardenbergh and approximately 6 acres owned by Mrs. Hardenbergh's children, legally described on the attached Exhibit A; and WHEREAS, as an essential element to the negotiations for the purchase of Nancy Chalmers Hardenbergh's property, it was agreed that Mrs. Hardenbergh could remain living on that portion of the property that is her homestead for up to five years and that the City would purchase the property in two phases. The City would take immediate title to the property owned by Mrs. Hardenbergh's children and to the property owned by Mrs. Hardenbergh excluding the portion that includes her home. The City has exclusive right to buy the remainder of the property (approximately 6.4 acres), including the home, within the next five years at a price established in the Purchase Agreement; and WHEREAS, the homestead parcel retained by Mrs. Hardenbergh is less that 10 acres and the sale of a portion of the property is governed by Minnesota Statutes, Section 462.358, Subdivisions 4a and 4b, as amended, and is subject to Section 500 of the Plymouth City Code, Subdivision and Platting of Land, requirhig Planning Commission and City Council approval; and WHEREAS, compliance of the provisions of Minnesota Statutes, Sections 462.358, Subdivisions 4a and 4b, as amended, and Plymouth City Code Section 500 will create an unnecessary hardship upon Nancy Chalmers Hardenbergh. NOW, THEREFOREBE. IT RESOLVED, that the City Council has reviewed the lot split created by the two phase purchase of the Nancy Chalmers Hardenbergh property and finds that it complies with all of the provisions of Section 500 and the City Council grants a variance from the provisions of Section 500 of the Plymouth City Code, Subdivision and Platting of Land as is permitted under Subsection 500.43.
