The City will augment the height of the berm at the southeast corner of the pond to help prevent overflowing of the berm. 3. The City finds that the entire area is in a legally recognized drainage easement for ponding purposes and that the City is not renouncing any legal rights for drainage and ponding that currently exist. 2. Since a drainage easement for ponding exists, the City recognizes no legal responsibility to take any action to protect trees within its easement. 3. The City is not guaranteeing the preservation of the trees as a result of these actions, but hopes these actions will improve the likelihood that trees will survive and provide a buffer for the residential neighborhood from County Road 9. 4.
