RESOLUTION NO. 95- 604
RESOLUTION DIRECTING CITY ACTIONS
REGARDING DRAINAGE COMPLAINTS IN
SUGAR HILLS 2ND SUBDIVISION
WHEREAS, drainage concerns relating to a storm water treatment pond located on or
adjacent to Lots 15, 16 and 17, Block 2, of SugcL, Hills 2nd Addition have been
brought to the City's attention by Judith Martin, resident of Sugar Hills 2nd Addition;
and,
WHEREAS, improvements to the drainage in the area may help to preserve trees which
help buffer the neighborhood from New County Road 9 now under construction; and,
WHEREAS, Judith Ma,tin has proposed a series of specific actions to correct many of
the drainage concerns;

1. The City will take action to channel the outflow of the pond to the nearby
wetland through widening the existing shallow trench, lining it, and placing small
berms along its edge.
2. The City will augment the height of the berm at the southeast corner of the
pond to help prevent overflowing of the berm.
3. The City will require the developer of the subdivision to correct and stop
the seepage from around the outlet pipe.
4. The City will place a small berm around the rip -rap belcw the outlet pipe to
prevent the water flowing from the outlet pipe from ponding or spreading out into
adjacent wooded areas.
5. The City will attempt to drain the largest area of trapped water located in the
trees between the pond and the wetland by trenching to the adjacent wetland.
BE IT FURTHER RESOLVED THAT:
1. The City finds that the entire area is in a legally recognized drainage
easement for ponding purposes and that the City is not renouncing any legal rights for
drainage and ponding that currently exist.
2. Since a drainage easement for ponding exists, the City recognizes no legal
responsibility to take any action to protect trees within its easement.
3. The City is not guaranteeing the preservation of the trees as a result of these
actions, but hopes these actions will improve the likelihood that trees will survive and
provide a buffer for the residential neighborhood from County Road 9.
4. These actions constitute all of the City's intended actions in this matter and
the City finds these actions to be a satisfactory response by the City.
