RESOLUTION NO. 9S - 602
t AUTHORIZING THE VACATION OF 41ST AVENUE STREET EASEMENT
WHEREAS, a petition was received to vacate a certain portion of 41st Avenue street easement; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed
to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for October 3, 1995 in
accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of October 3, 1995; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on October 3, 1995 to inform any and all interested
parties relevant to the vacation of a portion of 41st Avenue street easement; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY' OF
PLYMOUTH, MINNESOTA: That the following portion of 41st Avenue street easement be vacated:
That part of 41st Avenue North which lies easterly of the west line of Lot 6, Block 6,
Plymouth Oaks Addition extended southerly and west of the west line of Lot 1, Block 1,
Courtyards of Plymouth Oaks extended northerly according to said plats on file and of
record in the office of the County Recorder, Hennepin County, MN.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains
and hydrants thereon or thereunder, to continue maintaining the same, to enter upon such way or
portion thereof vacated to repair, replace, remove otherwise attend thereof.
FURTHER, subject to a drainage and utility easement over, under, and across all of vacated 41st
Avenue street easement.
Adopted by the City Council on October 3, 1995.
