RESOLUTION 95- 550
APPROVING RPUD FINAL PLAT FOR U.S. HOME CORPORATION FOR
PROPERTY LOCATED AT THE SOUTH E.ND OF THE COMSTOCK LANE
NORTH CUL-DE-SAC LYING SOUTH OF 39TH AVENUE NORTH (95095)
WHEREAS, U.S. Home Corporation has requested RPUD Final Plat approval for
Westbranch 5th Addition, a plat of two single family lots, located at the south end of
the Comstock Lata; North cul-de-sac lying south of 39th Avenue North.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the Final Plat for Westbranch 5th Addition; and
FURTHER, that the following conditions be met prior to recording of, and related to
said plat:
1. Final Plat approval is hereby granted for Westbranch 5th Addition in
accordance with the application and plans received by the City on August 9,
1995, except as amended by this resolution.
I 2. Payment of park dedication fees -in -lieu of dedication for two lots in accordance
with the Dedication Policy in effect at the time of filing the Final Plat, prior to
filing the Final Plat.
3. Minimum single family setbacks shall be:
a. 25 -foot front yard setback
b. 10 -foot side yard setback
C. 25 -foot rear yard setback
4. Maximum lot coverage shall be 20 percent.
5. Private driveway access shall be limited to internal public roads and prohibited
from Dunkirk Lane North.
6. Final Plat mylars shall refer to RPUD 92-7.
7. Standard Conditions:
a Compliance with the City Engineer's Memorandum.
�. hamoval of any hazardous trees from the property at the owner's expense.
c. No building permits shall be issued until a contract has been awarded for
sewer and water.
d. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.

e. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
f. Appropriate legal documents regarding Homeowners Association
documents, covenants and restrictions, as approved by the City Attorney,
shall be filed with the Final Plat.
g. Submittal of required utility and drainage easement documents as approved
by the City Engineer prior to filing the Final Plat.
h. No yard setback Variances are granted or implied.
L The Developer shall hold the City and its officers, employees, and agents
harmless from claims :rade by itself and third parties for damages sustained
or costs incurred resulting from plat approval and development. The
Developer shall indemnify the City and its officers, employees, and agents
for all costs, damages, or expenses which the City may pay or incur in
consequence of such claims, including attorneys' fees.
