CITY OF PLYMOUTH
RESOLUTION NO. 95 - 530
AUTHORIZING THE VACATION OF DRAINAGE AND UTILITY EASEMENTS AND
DRAINAGE EASEMENT FOR PONDING PURPOSES
PARCEL 15-119-2242.0006
WE REAS, a petition was received to vacate drainage and utility easements and drainage
easement for ponding purposes within Parcel 15-118-22-42-0006; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposo' to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for Sepicmber 5, 1995
in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of September 5, 1995; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the Council did hold a public hearing on September 5, 1995 to inform any and all
interested parties relevant to the vacation of drainage and utility easements and drainage easemens
for ponding purposes whhin Parcel 15-118-22-42-0006; and
WHERBAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, TH&REFORB, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA; That the following drainage and utility easement and drainage
easement for ponding purposes be vacated;
Commencing at the southwest comer of the north quarter of the southwest quarter
of the southeast quarter of said Section 15; thence north 00 degrees 08 minutes 22
seconds west assumed bearing along the west line of the southeast quarter of said
Section 15 a distance of 370.51 feet; thence north 89 degrees 37 minutes 22
seconds east a distance of 706.50 feet to the point of beginning of the parcel to be
described; thence south 00 degrees 08 minutes 22 seconds west, parallel with the
west line of Bald southeast quarter to the south line of said north quarter of the
southwest quarter of the southeast quarter; thence north 35 degrees 08 minutes 22
seconds east 140.00 feet; thence north 03 degrees 08 minutes 22 seconds east
225.00 feet; thence north 48 degrees 51 minutes 3R seconds west 141.75; thence
south 13 degrees 49 minutes 55 seconds west 61.74 feet to the point of beginning.
Adopted by the City Council on September 5, 1995.
