RESOLUTION NO. 93 - 528
AUTHORtUNG THE VACATION OF A PORTION OF XENIUM LANE STRERr
RIGHT-OF-WAY IN PARCELS 15-118-22-42-0010,15-118-22-34.Oc�2S,
15-118-2243-0001 and 15-118-22-42-0006
WHEREAS, a petition
adjacent to Parcels
15-118-22-42-0006; and
was received to vacate a portion of Xenium Lane street right-of-way
15-118-22-42-0010, 15-118-22-34-0025, 15-118-22-43-0001 and
YMMURAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for September 5, 1995
in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of September 5, 1995; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mall;
and
WHEREAS, the Council did hoid a public hearing on September 5, 1995 to inform any road all
Interested parties relevant to the vacation of a portion of Xenium Lane street right-of-way
adjacent to Parcels 15-118-22-42-0010, 15-118-22-34-00259 15.118-22-43-0001 and 15-118-22-
42-M; and
WHMtEAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, THEREFr)RE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That the following portion of Xenlem Lane street right-of-
way be vacated:
That pact of Xenium Lane adjacent to Pamela 15-118-22-42-0010, 15-118-22-34-
0025, 15-118-22.43.0001, and 15-118-22-42-0006 which lies north of the north
line and Its westerly extension of Heritage West 2nd Addition, according to said
plat on file and of record in the office of the County Recorder, Hennepin County,
Minnesota and which lies within the South Half of Section 15, Township 118,
Range 22, Hennepin County, Minnesota,
FURTHER, that said vacation shall not affect the authority of any person, corporation, or
municipality owning or controlling electric or telephone poles and lines, gas and sewer linea,
water pipes, mains and hydrants thereon or thereunder to continue maintaining the same to enter
upon In such way or portion thereof vacated to repair, replace, remove, or otherwise attend
thereto.
Adopted by the City Council on September 5, 1995.
