HomeMy WebLinkAboutCity Council Resolution 1995-525( CITY OF PLYMOUTH RESOLUTION 9S- S2S APPROVING MPUD PRELIM NARY PLAN AMENDMENT, CONDITIONAL USE PERMIT AMENDMENT AND FINAL PLAN/PLAT FOR EDEN TRACE FOR PROPERTY LOCATED WEST OF NIAGARA LANE, SOUTH OF THE INTERSECTION OF 23RD AVENUE NORTH AND POLARIS LANE NORTH (95079) WHEREAS, Eden Trace has requested an MPUD Preliminary Plan Amendment, Conditional Use Permit Amendment and Final Plan/Plat for Twin Corp. Master Distributor, 1W. for property legally described as follows: Lot 1, Block 1, Parkers Lake Corporate Center 7th Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Eden Trace for an MPUD Preliminary Plan Amendment, Conditional Use Permit Amendment and Final Plan/Plat for Twin Corp. Master Distributor, Inc., subject to the fotowing conditions: 1. This approval permits the construction of a 27,828 square foot multi -tenant office/warehouse building, in accordance with the plans received by the City on August 29, 1995, except as amended by this resolution. 2. Park dedication fees have been paid through previous approvals. 3. Any signage shall be in compliance with the MPUD for the Parkers Lake Corporate Center. 4. All waste and waste containers shall be stored within the enclosure structure. 5. PUD flexibility is granted for the placement of loading dock within 300 feet of residential property on the basis of the unique circumstances related to the development of this subdivision. 6. Building permits may not be issued until construction has begun on the NURP pond that serves this property. 7. The proof of parking plan shall show the construction of 50 parking spaces and the deferral of 38 parking spaces for tlrture consturction, 8. The well site easement shall be revised to 50 feet by 100 feet. 95079, Page 2 10. Standard Conditions: I A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, fire Maes, and fire lane signage. F. An 8112 x 11 inch 'As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Submission and approval of fire flow calculations prior to the issuance of building permits. H. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. I. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 7. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. i K. Final Plat mylars shall refer to MPUD 83-1. L. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and t1drd panties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
