FOR PROPERTY LOCATED NORTH OF OLD ROCKFORD ROAD AND EAST OF BALSAM LANE NORTH (95081) WHEREAS, Janco, Inc. has requested Final Plat approval for Forster Preserve Plat 3, a plat of two single family lots, located north of Old Rockford Road and east of Batsam Lane North. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat for Forster Preserve Plat 3; and FURTHER, that the following conditions be met prior to rero:ding of, and related to said plat: 1. Final Plat approval is hereby granted for Forster Preserve Plat 3 in accordance with the plans received by the City on July 21, 1995, except as amended by this resolution. ( 2. Payment of park dedication fees -in -lieu of dedication for one additional lot in accordance with the Dedication Policy in effect at the time of filing the Final Plat, prior to tiling the Final Plat. 3. Any structures on the property shall be removed prior to filing of the Final Plat. 4. For purposes of determining the required building setbacks from lot lines, the following shall apply: a. LoU -- The south and west lot lines shall be front lot lines, the east lot line shall be a side lot line, and the north lot line shall be the rear lot line. b. IA"I -- The south lot line shall be a front lot line, the west and east lot lines shall be side lot lines, and the north lot line shall be the rear lot line. 5. Minimum building setbacks shall be: a. 30 -foot front yard setback b. 9 -foot (living) and 6 -foot (garage) side yard setbacks c. 20 -foot rear yard setback d. 35 -foot wetland setback 6. Minimum lot size shall be 11,700 square feet. 7. Maximum lot coverage shall be 20 percent. Resolution 95- 505 , Page 2 • 8. Approved minimum lot width shall be 85 feet. 9. Appropriate legal documentq regarding Homeowners Association documents, covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. Specific refer mr c shall be made to the maintenance of the scorning fence along County Road 9 and to notification and description of the activities of Forster Meat Market. 10. Final Plat mylars shall refer to RPUn 94-2. 11. Standard Conditions: a. Compliance with the City Enginee►'s Memorandum. b. Removal of any hazardous trees from the property at the owner's expense. c. No building permits shall be issued until a contract has been awarded for sewer and water. d. Compliance /ith Policy Resolution 79-RO regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. e. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. f. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. ( g. No yard setback Variances are granted or implied. h. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
