CITY OF PLYMOUTH
RESOLUTION 95. 465
APPROVING RPUD FINAL PLAT AND DEVELOPMENT CONTRACT FOR
JANCO, INC. FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF
OLD ROCKFORD ROAD AND PEONY LANE (94155)
WHEREAS, Janco, Inc. has requested a MPUD Final Plan/Plat for the Rockford Glen
PUD located at the southeast corner of Old Rochford .Road and Peony Lane; and,
WHEREAS, the City staff has prepared a Developmeat Contract covering the
improvements related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the MPUD Final Plan/Plat and Development Contract fa. Janco, Inc. located at the
southeast corner of Old Rockford Road and Peony Lane, and,
FURTHER, that the Development Contract for said plat be approved, and that the
Mayor and City Manager be authorized to execute the D:velopment Contract on behalf
of the City, and,
FURTHER, that it should and hereby does approve the following to be met, prior to
recording of, and related to said plat:
1. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of recording the Final Plat in combination
with land dedication for trail outlots. The developer shall be reimbursed for the
cast of paving the trail along Old Rockford R:ad.
2. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits
and filing of the Final Plat,
3. The developer shall install wetland monumentation delineating the wetland
within each lot. The monument design shall be approved by the Community
Development Department.
4. The parking spaces adjacent to 41st. Ave. N shall be screened from the existing
residential neighborhood.
5. Development Standards:
Single family:
a. 25 -foot front yard setback
b. 25 -foot rear yard setback
C. 10 -foot side yard setback to living space
d. 5 -foot side yard setback to garage
C. 25 -foot setback to wetlands
f. 35 -foot setback to Rockford Road
Multi family:
a. 25 -foot front yard setback
b. 10 -foot side yard setback
C. 15 -foot rear setback
d. 35 -foot setback to Rockford Road
e. 25 -foot setback to wetlands
f. 20 -foot parking setback to wetlands
g. 50 -foot setback to T.H. 55
G. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's
expense.
C. No building permit shall be issued until a contract has been awarded for
sewer and water.
D. Street names shall comply with the City Street Naming System.
E. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or contai,ung any open
storm water drainage facility.
F. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
G. Private driveway access shall be limited to internal public roads and
restricted from T. H. 55.
H. Final Plat mylars shall rete► to MPUD 95-1.
I. Appropriate legal documents regarding Homeowners Association
documents, covenants and restriction as approved by the City Attorney
shall be filed with the Final Plat.
J. Location and number of fire hydrants shall be approved by the Fire
Division,
K. Compliant with Fire Division regulations regarding fire lane
requirements and fire suppression systems
L. The multi -family structures shall proved a fire extinguishing system if
the site cannot meet the minimum hoselay requirements.
M. Submission of a Site Improvement Performance Agreement prior to
issuance of building permits.
N. The contract for the sanitary sewer shall be awarded prior to recording
the Final Plat with Hennepin County.
