CITY OF PLYMOUTH
RESOLUTION 95 - 462
APPROVING RPUD FINAL PLAT AND DEVELOPMENT CONTRACT FOR
MISSION PARTNERS FOR PROPERTY LOCATED AT THE SOUTHEAST
CORNER OF OLD ROCKFORD ROAD AND 41ST. AVE. N. (94158)
WHEREAS, Mission Partners has requested a RPUD Final Plat for Mission PUD
Amendment located at the southeast corner of Old Rockford Road and 41st. Ave. N.;
and,
WHEREAS, the City staff has prepared a Devtlopment Contract covering the
improvements related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED 3Y THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the RPUD Final Plat and Development Contract for Mission Partners located at the
southeast corner of Old Rockford Road and 41st. Ave. N., and,
FURTHER, that the Development Contract for said plat be approved, and that the
Mayor and City Manager be authorized to execute the Development Contract on behalf
i of the City, and,
FURTHER, that it should and hereby does approve the following to be met, prior to
recording of, and related to said plat:
1. Approved setbacks are:
a. 35 -foot front yard setback, except that a 25 -foot setback is permitted for
Lot h Block 2
b. 10 -foot side yard setback
C. 25 -foot rear yard set back
d. 25 -foot setback to wetlands
e. 85 -foot minimum lot width
2. The rear yard grading limit shall be established 10 feet closer to the road for
lots where a 25 -foot front yard setback is used.
2. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Payment of park dedication fees -in -lieu of dedication in accordance with
the Dedication Policy in effect at the time of recording the plat with
Hennepin County.
C. An eight -foot wide trail shall be constructed by the developer per City
standards along Old Rockford Road The developer shall be reimbursed
for trail construction costs. The trail grade, base and ground cover shall
be provided by the developer with no credit given.
d. A 15 -foot trail ePsement shall be submitted prior recording the Final
Plat.
e. No building permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water.
f. Removal of all hazardous trees from the property at the owner's
expense.
g. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.
h. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
L No building permits to be issued until the Final Plat is filed and recorded
with Hennepin County.
j. Appropriate legal documents regarding Homeowner Association
covenants and restrictions, as approved by the City Attorney, shall be
filed with the Final Plat. The Documents shall include provisions for
H.O.A maintenance of all cul-de-sac islands.
k. The Final Plat mylars shall contain a statement noting that the plat is
part of the approved RPUD 76-1, per Section 9 of the Zoning
Ordinance.
1. The Development Contract, as approved by the City Council, shall be
fully executed prior to release of the Final Plat.
