RESOLUTION 95 - 443
VIIIiHRBAS, John and Ruth Rounds have requested a Final Pie for Rounds Addition, a
plat of four single family lots on a 2.5 acre parcel located south of 33rd Avenue North
and east of Xenium Lane; and
WHEREAS, the City staff has prepared a Development Contract covering the
improvements related to said plat.
NOW, THEREFORE, BE rr HMMY RBSOLVFD BY THE CITY COUNCIL OF
THE CrrY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the Final Plat and Development Contract for Rounds Addition, and,
FURTHER, that the Development Contract for said plat be approved, and that the
Mayor and City Manager be authorized to execute the Development Contract on behalf
of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to
said plat:
1. Final Plat approval is hereby granted for the Rounds Addition in accordance with
the plans received by the City on May 26, 1995 with revisions received July 25,
1995, except as amended by this resolution.
2. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of filing the Final Plat.
3. A Variance is granted for Lot 1 to permit the larger of the two existing
accessory buildings to remain of the site.
4. The smaller of the two existing accessory structures on Lot 1 shall be removed
prior to filing the Final Plat.
5. Variances are granted to allow creation of Lot 4 with a lot width of 90 feet and
a lot area of 17,129 square feet.

6. Submittal of information by a Soils Engineer, as approved by the Building
Official, relating to soil corrections for Lots 19 2, and 3, prior to issuance of
building permits.
7. The existing driveway for Lot 4 that provides access to 33rd Avenue shall be
relocated to the east to reduce the slope and to provide a landing area at the top
of the driveway before entering 33rd Avenue.
8. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. No building permits shall be issued until a contract has been awarded for
municipal sewer wid water.
d. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
e. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
f. Submittal of required utility and drainage easement documents as approved
by the City Engineer prior to filing the Final Plat.
g. No yard setback Variances are granted or implied.
h. The Developer shall hold the City and its officers, employees, and agents
harmless from claims made by itself and third patties for damages sustained
or costs Incurred resulting from plat approval and development. The
Developer shall indemnify the City and its officers, employees, and agents
for all costs, damages, or, expenses which the City may pay or incur in
consequence of such claims, including attorneys' fees.
I. Street names shall comply with the City Street Naming System.
J. Compliance with the City's Tr9e Preservation Policy.
k. The Lit;velopment Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
