HomeMy WebLinkAboutCity Council Resolution 1995-442CITY OF PLYMOUTH RESOLUTION 95 - 442 APPROVING PRELIMINARY PLAT AND VARIANCES FOR JOHN AND RUTH ROUNDS FOR PROPERTY LOCATED SOUTH OF 33RD AVENUE NORTH AND EAST OF XENIUM LANE NORTH (95035) WHEREAS, John and Ruth Rounds have requested a Preliminary Plat and Variances for Rounds Addition, a plat of four single family lots on a 2.5 acre parcel located south of 33rd Avenue North and east of Xenium Lane North; and WHEREAS, the Subject Property is legally described as: The North 300 feet of the West 300 feet of the North 1/2 of the Southwest Quarter of the Northeast Quarter of Section 22, Township 118, Range 22, as measured on the North and West lines thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. 1 NOW, THEREFORE, BE IT IIEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of John Rounds for a Preliminary Plat and Variances for Rounds Addition, subject to the following conditions: 1. The Final Plat shall be in compliance with the Preliminary Plat plans received by the City on May 26, 1995, except as amended by this resolution. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 3. Compliance with the City's Tree Reservation Policy, including the requirement for a tree preservation plan with the final plat submission which indicates which trees are to be preserved. 4. A Variance is granted for Lot I to permit the larger of the two existing accessory structures to remain on the site. 5. The smaller of the two existing accessory structures on Lot 1 shall be removed prior to filing the Final Plat, 6. Variances are granted to allow creation of Lot 4 with a lot width of 90 feet and a lot area of 17,129 square feet. Res. 95- 442 , Page 2 7. Submittal of information by a Soils Engineer, as approved by the Building Official, relating to soil conditions for Lots 1, 2, and 3, prior to issuance of building permits. 8. Standard Conditions: a. Compliancy with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. No building permits shall be issued until a contract has been awarded for sewer and water. d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. e. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. f. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. g. No yard setback Variances are granted or implied. h. The Developer shall hold the City and its officers, employees, and agents limmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall inder-inify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
