HomeMy WebLinkAboutCity Council Resolution 1995-440• CITY OF PLYMOUTH RESOLUTION 95 - 440 E11=11101"ON r I'll . o) oi In • •.IIm . • 2TGIA V WHEREAS, Prime Builders, Inc. has requested an MPUD Final Plan/Plat for Bass Lake Estates 3rd Addition located at the northeast corner of Bass Lake Road and Northwest Boulevard; and WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the MPUD Final Plan/Flat and Development Contract for Bass Lake Estates 3rd Addition, and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. MPTJD Final Plan/Plat approval is hereby granted for the Bass Lake Estates 3rd Addition in accordance with the plans received by the City on July 5, 1995, except as amended by this resolution. 2. Payment of park dedication fees -in -lieu of dedication with appiopriate credits in an amount determined according to verified acreage and according to the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County. 3. A deed for Outlot A shall be given to the City prior to filing the Final Plat with Hennepin County, 4. Minimum yard setbacks for detached units shall be as follows: 30 feet for the front yards, except that single family homes in Block 2 may have a 25 -foot front yanl setback • Ten feet (living) and six feet (garage) for the side yards • 20 feet for the rear yards • Minimum setbacks for residential units to Bass Lake road and Northwest Boulevard right-of-way shall be 50 fwt. 0 • Resolution 95- 440 , Page 2 (95065) 5. Minimum yard setbacks for attached units shall be as follows: • 30 feet for the front yards • Ten feet for the side yards • 20 feet for the rear yards • Minimum setbacks for residential units to Bass Lake Road and Northwest Boulevard right-of-way shall be 50 feet. 6. One 4 ft. by 8 ft. sign shall be placed at Bass Lake Road and future Northwest Boulevard showing the Final Plat as approved by this resolution, particularly noting future County Road 61 (Northwest Boulevard). 7. Standard Conditions: A. Compl:ance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permits shall be issued until a contract has been awarded for municipal sewer and water, and the MPGA permit issued. D. No building permits shall be issued until the Final Plat has been filed and recorded with Hennepin County. E. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. F. Street names shall comply with the City Street Naming System. G. The Final Plat inylars shall contain a statement noting that the plat is part of the approved MPL1D 85-1, per Section 9 of the Zoning Ordinance. H. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. I. Appropriate legal documents regarding Homeowner Association documents, covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. J. Private driveway access shall be limited to internal public roads and shall be prohibited from Bass Lake Road and Northwest Boulevard. K. The D.-velopment Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. L. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by the developer and third patties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees, Adopted by the City Council on August 1, 1995.
