HomeMy WebLinkAboutCity Council Resolution 1995-438M CITY OF PLYMOUTH RESOLUTION 9S - 438 APPROVING RPUD FINAL PLAN/PLAT AND DEVELOPMENT CONTRACT FOR JANCO INC. FOR PROPERTY LOCATED WEST OF NORTHWEST BLVD. AND SOUTH OF COUNTY ROAD 9 (RPUD 95-2) (94159) WHEREAS, Janco Inc. has requested approval for a RPUD Final Plan/Plat for French Ridge for property located west of Northwest Blvd. and south of County Road 9; and, WHARBAS, the City staff has prepared a Development Contract covering the improvements related to said plat; NOW, THEREFORE, RE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTP, MINNESOTA, that it should and hereby does approve the Final Plan/Plat and Development Contract for French Ridge for property located west of Northwest Blvd, and south of County Road 9; and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. Maximum lot coverage shall be 80 percent. 2. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits and filing of the Final Plat. 3. The developer shall install wetland monumentation delineating the wetland within each lot. The monument design shall be approved by the Community Mwelopment Department. 4. The cu,iira t fvr Xenium/Vinewood Lane shall be awarded prior to issuance of building l��,mits. 5. Prior to the dedication of the outlot to the City for open space purposes, the developer shall ompleto Phase I Bnvitontuental Audit (and a Phase lI Audit if deemed necessary by the Phase I Audit), and complete all required cleanup work on the site. • Resolution 95- 438, Page 2 6. The cul-de-sac shall be posted "Left turns prohibited onto Northwest Boulevard at all times". Staff is directed to negotiate with Hennepin County to attempt to obtain reasonable and necessary signage to prohibit left turning movements onto the cul-de-sac from northerly traffic on Northwest Boulevard for the safety of the residents in and around the area. 7. Park dedication requirements have been satisfied through other subdivision approval for Parkers Lake North. 8. Signage shall be in compliance with the Zoning Ordinance except that one additional arra identification sign is permitted for a total of three area identification signs. 9. Development Standards: A. 25 -foot front yard setback to street right-of-way B. 20 -foot setback between buildings C. 25 -foot setback to the subdivision property line D. 50 -foot setback to Northwest Blvd, right-of-way E. 25 -foot wetland setback 10. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permit shall be issued until a cont►art has been awarded for municipal sewer and water. D. Street names shall comply with the City Street Naming System, B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. F. No building permits shall be issued tontil the Final Plat is filed and recorded with Hennepin County. O. Private driveway access shall be lintuted to internal public roads and restricted front Northwest Blvd., Vinewood Lane and Xenium Lane. H. Final Plat rnylars shall refer to R.PUD 95-2. I. Appropriate legal documents regarding Homeowners Association documents, covenants and restriction as approved by the City Attorney shall be fried with the Final Plat, J. Location and number of fire hydn►nts shall be approved by the Fire Division, K. Compliance with Piro Division regulations regarding fire lane requirements and fire suppression systems 0 • Resolution 95- 438, Page 3 L. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. M. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. N. An 8112 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. O. Submission and approval of fine flow calculations prior to the issuance of building permits. P. Submittal of required utility and drainage easements as approved by the City Engneer prior to filing the Final Plat. Q. Compliance with the terms of City Council Resolution 89-439 regarding tree preservation. R. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. Adopted by the City Council on August 1, 1995.
