OPUS Corporation has requested an MPUD Preliminary Plan Amendment, Conditional Use Permit, and Final Site Plan for Trenton Commerce Center for property legally described as follows: Lot 1, Block 2, Bass Creek Business Park Addition, according to the recorded plat thereof, Hennepin County, Minnesota, except the northerly 151.08 feet thereof. WHBREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Opus Corporation for an MPUD Preliminary Plan Amendment, Conditional Use Permit, and Final Site Plan for Trenton Commerce Center, subject to the following conditions: 1. This approval permits the construction of a 98,577 squan; foot multi -tenant offrcelwarehouse building, in accordance with the plans received by the City on June 30, 1995, except as amended by this resolution. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of building permit issuance, prior to the issuance of building permits. 3. Any signage shall be in compliance with the MPUD for the Bass Creek Business Park. d. All waste and waste containers shall be stored within the enclosure structure, and no outside storage is permitted. 5. Approval by the Shingle Creek Drainage District prior to issuance of building permits. 6. That the area to be seeded, as shown on the plan, be seeded with a prairie grass seed mixture. Resolution 95-436 , Page 2 7. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and appro-. els per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, fie lanes, and fire lane signage. F. An 8 112 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Submission and aprpruval of fie flow calculations prior to the issuance of building permits. H. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. Adopted by the City Council on August 1, 1995.
