COUNTY ROAD 9 BETWEEN« c LANE AND DUNKIRK 0. WHEREAS, US Homes has requested a Conditional Use Permit for property located north of County Road 9 between Vicksburg Lane and Dunkirk Lane, legally described as follows: Outlot A of Sugar Hills Addition, Outlot F of Plyuar:t. i)resbyterian Church Addition, and Outlot L of Westbranch 2nd Addition. WHEREAS, the Conditional Use Permit would allow the stockpiling of 11,400 cubic yards of dirt on the site for a one year term; and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CI'T'Y OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by US Homes for a Conditional Use Permit to stockpile 11,400 cubic yards of fill at property located north of County Road 9 between Vicksburg Lane and Dunkirk Lane, subject to the following conditions: 1. This Conditional Use Permit allows the stockpiling of 11,400 cubic yards of dirt on the site, in accordance with the plans received by the City on May 260 1995, except as amended by this resolution. 2. Compliance with the city Engineer's Memo. 3. Compliance with all applicable City Codes regarding erosion contnil, including installation of silt fences and establishment of vegetation. 4. This Conditional Use Permit shall expire on August 1, 1996. S A complete Grading Permit application shall be submitted for the stockpiles, all required financial guarantees shall be submitted, and all tees paid prior to issuance of the permit. 6. The plan shall be revised to clitninate stockpiling of dirt on the future Archer Lame North right-of-way, as approved by the City Engineer. Resolution 95- 435 , Page 2 7. The applicant shall place and maintain signage near the stockpiles indicating that they are temporary. Such signage shall be. visible from the Sugar Hills and Weatbiaach developments and is subject to a sign permit. 8. The dirt shall be hauled in from the Westbranch 2nd and 3rd Additions, and shall not be hauled in from other oaf cite locations. 9. Any subsequent phases or expansions am subject to required reviews and approva►s per Ordinance provisions. 10. This permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. Adopted by the City Council on August 1, 1995.
