WHBRSAS, Scherber Properties Partnership has requested approval of a Raddeatial
Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for the
development of approximately 18.5 acres located south of Old Rockford Road at 41st.
Place North;
The property is more specifically described as:
That part of the West Half of the Northwest Quarter of Section 17, Township
118, Range 22, Hennepin County, Minnesota, described as follows:
• Commencing at the Southeast corner of &.id West Half of the Northwest
Quarter; thence North on an assumed bearing of North along the east
line of said West Half 1334.59 feet; thence North 88 degrees 29 minutes
West 449.00 feet; thence North, and parallel with said east line, to the
center line of Hennepin County Road No. 9 (H.C.S.A.H. NO. 9 PLAT
9); thence westerly along said center line to a point 454.47 feet westerly
from said east line of -aid West Half of said Northwest Quarter,
measured along said center line; thence southerly to a point on the scwth
line of said West Half, said point being measured along said south line;
thence easterly along said south line to the point of beginning,
together with Lots 49 50 6, 7 and 8, Block 4, Holly Creek 3rd Addition,
Hennepin County, Minnesota.
Exception therefrom:
• that part of the West Half of the Northwest Quarter of Section 17,
Township 118 North, Range 22 West of the 5th Principal Meridian,
described as commencing at the southeast corner of the West Half of the
Northwest Quarter of said Section 17; thence North on an assumed
bearing, along the Fast line of said West Half of the Northwest Quarter a
distance of 1334.59 feet to the point of beginning of the land to be
described; thence North 88 degrees 29 minutes West a distance of
449.00 feet; thence South and parallel with the East line of said West
( Half of the Northwest Quarter a distance of 48.00 feet, thence North 89
degrees 47 minutes 40 seconds East a distance of 181.59 feet; thence
North 83 degrees 13 minutes 25 seconds East a distance of 83.92 feet;

WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE rr HEREBY RESOLVED Wk.? TTM CITY COUNCIL OF
THE CrrY OF PLYMOUTH, Iv MMOTA, that it should and hereby does approve
the request of Scheaber Properties Partnership for a Residential Planned Unit
Development Preliminary Plan/Plat and Conditional Use Permit, subject to the
following conditions:
1. Minimum lot size shall be 17,050 square feet.
2. Maximum lot coverage shall be 20 percent.
3. Approved minimum lot width shall be 95 feet.
4. Development Standards:
a. 25 -foot front yard setback
b. 10 -foot side yard setback to garages
d. 25 -foot rear yard setback
h. 15 -foot setback to wetland buffers
5. Lot 9 shall be redesigned to create a usable rear yard.
6. The RPUD Final Plat shall reflect the lot line adjustment between Lots 1 and 2
as shown on the plan received by the City on July 10, 1995.
7. Compliance with Section 6, Subdivision C of the Zoning Ordinance (Wetland
Protection Ordinance). Required buffers as identified on the plans dated June 9,
1995 and Exhibit A dated June 23, 1995:
a. 60 -foot buffer for Lots 1, 7 and 8
b. 50 -foot buffer for Lots 4 and 5
C. 40 -foot buffet for Lots 2 and 3
d. a buffer is not required on Lot 6
8. The RPUD Final Plan/Plat application shall include final analysis of the buffer
strip vegetation standards.
9. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits
and submission of PUD Final Plan/Plat.

10. The developer shall construct the trail to city specifications. The developer is
responsible for the trail base preparation and suitable ground corer. The City
will reimburse the developer fro the cost of paving the bituminous trail.
11. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. No building permit shall be issued until a contract has been awarded for
sewer and water.
d. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of recording the Final Plat.
e. Submittal of a 16 -foot trail easement prior to recording the Final Plat.
e. Street names shall comply with the City Street Naming System.
f. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
g. No building permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
h. Final Plat mylars shall refer to RPUD 92-1.
i. Appropriate legal documents regarding Homeowner Association
documents, covenants and restriction as approved by the City Attorney shall
be filed with the Final Plat.
j. Location and number of rim hydrants shall be approved by the Fire
Division.
k. Compliance with Policy Resolution 89439 regarding Tree Preservation.
