WHEREAS, ISD 284 and the City of Plymouth have requested a Final Plan/Plat for
Wayzata High School and the Ninth City Playfield located northset of the inter ection
of Peony Lane and the Soo Line Railroad; and,
WHEREAS, the City staff has prepared a Development Contract covering the
improvements related to said plat;
NOW, THEREFORB, SB IT HMMY RESOLVED BY THB CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the Final Plan/Plat and Development Contract for Wayzata High School and the Ninth
City Playfield located northwest of the intersection of Peony lane and the Soo Line
Railroad; and,
FURTHER, that the Development Contract for said plat be approved with a waiver of
the financial guarantee for Public Improvement Project Number 502 and 503, and that
the Mayor and City Manager be authorized to execute the Development Contract on
behalf of the City; and,
FURTHER, that It should and hereby does approve the following to be met, prior to
recording of, and related to said plat:
1. RPUD Final Plan/Plat approval is hereby granted for Wayzata High School and
the Ninth City Playfield in accordance with the plans received by the City on July
12, 1995, except as amended by this resolution.
2. Cross easements for public access to Lot 2, the City Playfield, shall be submitted
to the City and filed with the Final Plat.
3. Any signage shall be In compliance with the Ordinance.
4. Installation of wetland buffer monumentation as appropriate. The monument
design shall be approved by the Community Development Department.
5, Park dedication is addressed in the Joint Powers Agreement between the City and
( School District.

6. ISD 284 shall convey drainage and ponding easements to the City that will
encumber all wetlands on the site and Bim Crock.
7. The proposed development shall include construction of on-site basins for storm
water treatment that meet the National Urban Runoff Program (NURP) water
quality guidelines as well as the MPCA's Best Management Practices Manual
and City of Plymouth's water quality requirements.
8. ISD 284 shall sign an agreement with the City for future maintenance of the
storm water treatment ponds in accordance with standard City policy.
9. Strict adherence to the City's Erosion Control Ordinance shall be met.
10. The final landscaping plan shall be approved by the City Forester.
11. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Removal of all hazardous trees on the construction site at the owner's
expense.
C. If permits are required before the City awards contracts for sanitary
sewer, watermain and Penny Lane, the School District shall enter into a
"Hold Harmless Agreement" with the City.
D. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
B. No building permits shall be Issued until the Final Plat is filed with
Hennepin County.
F. Any signage shall be in compliance with the Zoning Ordinance.
G. Any subsequent phases or expansions are subject to required reviews and
approvals per ordinance provisions.
H. Final Plat mylars shall refer to RPUD 95-4.
I, Submittal of fire flow data with building permit application.
J. Compliance with Fire Division regulations regarding Fire Department
connection, fire lane requirements and fire suppression systema.
K. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted
prior to the release or reduction of any site improvement bonds per City
Policy.
L. Submittal of required drainage and utility easements as approved by the
City Engineer prior to filing the Final Plat.
M. The Development Contract, as approved by the City Council, shall be
fully executed prior to release of the Final Plat.
N. The Developer and the City shall provide each other Hold Harmless
Agreements.

O. Submission of a Site Improvement Performance Agreement prior to
issuance of building permits.
