HomeMy WebLinkAboutCity Council Resolution 1995-3810 CITY OF PLYMOUTH RESOLUTION 95- 381 APPROVING A CONDITIONAL USE PERMIT AND SITE PLAN FOR LPPTLE FLOWERS MONTESSORI SCHOOL FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF ZACHARY LANE AND OLD ROCKFORD ROAD (95043) WHEREAS, Little Flowers Montessori School has requested a Conditional Use Permit and Site Plan for a nursery school located at the southwest comer of Zachary Lane and Old Rockford Road; and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Little Flowers Montessori School for a CoWitional Use Permit and Site Plan for a nursery school located at the southwest comer of Zachary Lane and Old Rockford Road, subject to the following conditions: 1, The Site Plan is for the construction of a 6,000 square -foot Montessori School building in accordance with the plans revised on May 30, 1995, 2, The permit is issued to the Little Flowers Montessori School, Inc, and shall not be transferable. 3, This Conditional Use Permit shall cz., reviewed by staff in one year to determine if the 16 parking spaces are adequate. If staff determines that the parking spaces are not adequate, the applicant shall submit a Conditional Use Permit Amendment, Site Plan Amendment and other necessary applications for review and approval of a parking lot expansion to address the parking needed by the facility. 4, The Montessori School is limited to a maximum of 100 students at any given time. 5. The clientele shall be between the ages of 16 months and six years old. 6. Compliance with the Traffic Circulation and Parking Policy approved by the City Council on July 11, 1995. • t 8. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Submittal of a 20 -foot wide trail easement along Zachary Lane prior to issuance of building permits. j c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. d. Submission of required financial guarantee and Site Improvement j Performance Agreement for completion of site improvements within 12 months of the date of this resolution. i e. Any signage shall be in compliance with the Ordinance. 1 f. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. g. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. h. All waste and waste containers shall be stored in the trash enclosure shown on the plans revised on May 30, 1995, and no outside storage is permitted. 1. An 8 1/2 x 11 inch "As Built" FireProtection Plan and a24 x36 inch mylar "As Built" utility plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. J. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. k. The site shall be maintained in a sanitary manner.
