Rd. 24 and Medina Road; and, WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat; NOW, THEWORH, BE IT HEREBY RESOLVED BY THE C]TY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plan/Plat and Development Contract for Plymouth Ponds Business Center looted at the northwest corner of Co. Rd. 24 and Medina Road, and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City; and, FURTHER, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Development standards shall comply with the Zoning Ordinance standards. No flexibility is granted by this approval. 2. MPUD Final Plan/Plat approval is hereby granted for the Plymouth Business Center in accordance with the plans received by the City on March 17, 1995, and with the following restriction: The number of loading docks in the fast two buildings is limited to a total of 20 docks. Building number one may have a total of 11 docks and building number two may have a total of nine docks. No more than 16 of the docks in buildings one and two together may be operable at any one time. Dock doors not in use shall be rendered inoperable by barricading the doors, removing the door springs, or removing the doors. 3. A total of 292,000 square feet in four buildings is approved. Any increase may require preparation of an Environmental Assessment Worksheet. 4. Outside storage is prohibited anywhere in thin development. 3. Access from County Road 24 shall be as approvad by Hennepin County in their letter of May 16, 1995. The additional right -out access beyond the right turn in shown on the preliminary Plan/plat is approved and the plan shall be revised to accommodate the additional access. The right -in and right -out access to County Road 24 shall be constructed prior to issuance of a certificate of occupancy for the second building. 6. Cross u= easements shall be submitted to the City and filed with the Final Plat. The easements shall permit all traffic in the development the use of County approved access to County Road 24. 7. Any signage shall be in compliance with the Ordinance and the approved Master Sign Pian identified on shcet A-1 of the plans dated May 19, 1995. The development monument sign ahall comply with the dimensional requirements of the Zoning Ordinance for free standing sigma. 8. 11±e Developer shall design, construct and pay for a trail and bus stop on the south aide of Medina Road between Holly Law and Jewel Law. Plans and specificuions for the trail and bus stop shall be submitted to the City for approval by June 30, 19A. 9. Mw MPJD Final Plan approved for Lot 1, Block 1 is for a 76,800 square -foot industrial building. 10. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of building permit issuance. C. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. D. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements within 12 months of the date of this resolution for Building Number 1, including all of the berming and landscaping along Medina Road. H. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. F. Compliance with the Ordinance regarding the location of rue hydrants and fire lanes. G. All waste and waste containers shall be stored within the buildings, and no outside storage is permitted. • File 95005 Page 3 H. An 81/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. I. No building permit to be issred until the Final Plat is filed and recorded with Hennepin County. J. The Final Plat mylars shall contain a statement noting that the plat is part of the approved MPUD 91-1, per Section 9 of the Zoning Ordinance. K. Access shall be limited to internal public roads and probibited from Trunk Highway 55. L. Submittal of required drainage and utility easements as approved by the City Engineer prior to filing the Final Plat. M. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. N. The Developer shall hold cite City and its officers, employees, and agents harmless from claims made by the developer and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agems for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. 0. Approval of a Wetland Mitigation Plan. P. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. Q.
