AUTHORIZING THE VACATION OF
DRAINAGE AND UTILITY EASEM19M WITHIN THE SOUTH HALF OF
VACATED COUNTY ROAD NO.6 (NOW KNOWN AS 16TH AVENUE NORTH)
ADJACENT TO THE NORTH LINE OF BLOCK 7
BEACON HEIGHTS FIRST ADDITION
WHEREAS, a petition was received to vacate certain drainage and utility easements within the
south half of vacated County Road No. 6 (now known as 16th Avenue North) adjacent to the
north line of Block 7, Beacon Heights First Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WIERSAS, a public hearing with respect to said vacation was scheduled for June 6, 1995 in
accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of June 6, 1995; and
WHEREAS, all property owners adjacent to the proposed vacation were duly uotified by mail;
and
WHEREAS, the Council did hold a public hearing on June 6, 1995 to inform any and all
interested parties relevant to the vacation of drainage and utility easements within the south half
of vacated County Road No. 6 (now known as 16th Avenue North) adjacent to the north line of
Block 7, in Beacon Heights First Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVM :8Y THE CITY COU, �M OF THE Ci:7'Y
OF PLYMOUTH, MINNESOTA: That the following drainage and utility easements be vacaied:
That part of the south half of vacated County Road 6 (now known as 16th Avenue
North) shown on the plat of BEACON HEIGHTS FIRST ADDITION as County
Road 6 lying northerly of the north line of Block 7, Beacon Helghtd First Addition
which lies within the lines witnessed by the exterior face of that existing, 1 story,
concrete building number 12615, said property being further described as follows.
Commencing at the northwest comer of said Block 7; thence North 89 degrees 38
minutes 30 seconds east, assumed bearing, along the north line of said Block 7 a
distance of 100,00 feet; thence southeasterly continuing along said northerly line,
along a tangential curve concave to the southwest having a radius of 735.00 feet, a
central angle of 7 degrees 48 minutes 00 seconds, a distance of 100,00 feet, more
or less, to the northwesterly face of the above described building and the point of
beginning of the property to be described; thence North 61 degrees 30 minutes

Beat, along said building line, 26.2 feat; thence South 72 degrees Bast, along said
building line, 26.5 feet; thence Soutfi 27 degrees Bast, along said building line, 1.5
feet, more or less, to the north lire of said Block 7; thence northwesterly, along
said north line, 45.5 feet, more or less to the point of beginning. Also the
property described as commencing at the northwest corner of said Blick 7; thence
North 89 degrees 38 minutes, 30 second& Bast, along the north lino of acid Block
71 a distance of 100.00 feet; then= Southeasterly continuing along said northerly
line, along a tangential curve, concave to the southwest, having a radius of 735.00
feet, a cental angle of 13 degrees 21 minutes 37 seconds, a distance of 171 feet,
more or less, to the northwesterly face of said building and the point of beginning
of the property to be described; thence north 61 degrees 30 minute Bast, along
said building line, 10 feet; thence South 50 degrees Bast, along said building line,
10 feet, to the northerly line of said Block 7; thence northwesterly, along said
northerly lire, 15 feet, more or less, to the point of beginning.
