WHEREAS, Tony Eiden Company, the developers of CAVAN MEADOWS DEVELOPMENT propose to
fill wetlands for the construction of single residential family homes; and
WHEREAS, the developers, as City Council Resolution #93-383, were authorize to fill 0.26 acres of wetland
and replace them on site at a 1 to 1 ratio, and
WHEREAS, the original proposal site of the mitigated wetland is no longer feasible as a wetland
replacement area, and
WHEREAS, there aro no reasonable alternatives for the location of the CAVAN MEADOWS; and
WHEREAS, a new Mitigation Plan as required by the Wetland Conservation Act of 1991 has been prepared,
and
WHEREAS, the new Mitigation Plan proposes a 0.13 acre type 2 and 3 wetland mitigation on -alto and a 0.26
acre type 2 and 3 off-site mitigation wetland at Orchards of Plymouth in kind at a 2 to 1 ratio, and
WHEREAS, the Replacement Plan meets the requirements of the Wetland Act,
NOW, T H]MMORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOM, MINNESOTA; That the Mayor is authorized to amend the original wetland replacement plan
application of CAVAN MEADOWS subject to the following conditions:
1. The replacement wetland must be monitored for R five (5) year period from the date of completion.
2. The developers wetland consultant shall submit an annual monitoring report to the city of Plymouth on
the anniversary date of the completion of the replacement wetland for a period of five (5) years containing
information required in WCA rule 8420.0620.
3, The replacement wetland must be constructed concurrently with site grading.
4. The developer shall submit a letter of credit in the amount of the cost of the Replacement Plan. The letter
of credit shall be for a period of five (5) years, If during the fiscal year period the roplacemeat wetland
does not perform as proposed in the plan, work as necessary shall be undertaken by the developer to bring
It into conformance,
S. A deed creating a restrictive covenant running with the land for the replacement area must be recorded.
The deed shall be submitted to the City for approval before recording.
