HomeMy WebLinkAboutCity Council Resolution 1995-325CITY OF PLYMOUTH REfiWIAMON N0, 95 - 32S APPROVING FHIMG WETLANDS AND THE WETLAND REPI.ACZMZNT PLAN FOA Nanterre (91093) WHEMAS, the developers of NANEE RRB propose to fill wetlands for the cmMuctiom of single family raddotial homes; and WHBRBAS, tbare are no reasonable alternative: for the location of the NANTERRE; and WEMM S, a Mitugation Pian was prepared replacing the wetlands in kind at a 2 to 1 natio which is required by the Wetland Conservation Act of 1991; and WHMREAS, the Replacement Plan meds the requirements of the Wetland Act. NOW, TI MMRB, BB IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE MY OF PLYMOUTH, M NNBSMOA: That the Mayor is authorized to execute the LOU'S Fundings of Fads, approving the filling of wetlands W the Replacement Plan for wetland restoration in SW NB Sec. B. subject to the following Mviitlorw: 1. The -eplacement wetland must be monitored for a five (S) year period from the date of completion. 2. The developers wetland consultant shall submit an annual monitoring report to the city of Plymouth on the anniversary date of the completion of tha replacement wetland for a period of five (5) years containing information required in WCA rule 8420.0620. 3. The replacement wetland must be constructed concurrently with site grading. 4. The developer shall submit a letter of credit in the amount of the cost of the Replacement Plan. The letter of credit shall be for a period of five (5) years. If tinning the fiscal year period the replacement wetland does not perform as proposed in the plan, work as necessary shall be undertaken by the developer to bring it into conformance. 5. A deed creating a restrictive covenant running with the Sand for the rephicement area must be recorded. The deed shall be submitted to the City for approval before recording.
