HomeMy WebLinkAboutCity Council Resolution 1995-312• CITY OF PLYMOUTH RESOLUTION 9S- 312 APPROVING PRELRYUNARY PLAT AND VARIANCES FOR LUTZ CONSTRUCTION FOR PROPERTY LOCATED AT 15 NIAGARA LANE NORTH (95042) WHBRW, Lutz Construction has requested approval of a Preliminary Plat and Variances for Lutzs Cedar View Addition, a plat for three kAs on 1.9 acnes 4kocated at 15 Niagara Lane North (Lot 2, Block 1, Malmstedt Addition); and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, WMNESOTA, that it should and hereby does approve the request of Lutz Construction for a Preliminary Plat and Variances for Lutzs Cedar View Addition, subject to the following conditions: 1. Tho Final Plat shall be in compliance with the Preliminary Plat plans received by the City on May 21 1995, except as amended by this resolution. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 3. Variances are granted for lot width as follows: Lot 1 -- 100.03 feet Lot 2 -- 102.02 feet Lot 3 -- 100.03 feet 4. The garage on Lot 1 shall be removed prior to filing of the Final Plat. 5. Compliance with the City's Tree Preservation Policy, including the requirement for a tree preservation plan to be submitted with the Final Plat application which indicates which trees are to be preserved. 6. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of any hazardous trees from the property at the owner's expense. c. No building permits shall be issued until a contract has been awarded for sewer and water. • Resolution 95- , Page 2 d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. e. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. f. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. g. No yard setback Variances are granted or implied. h. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
