WHEREAS, Weston, Hilloway Corp. and Moen Leuer Construction has requested
approval of a Residential Planned Unit Development Concept Pian, Preliminary
Plan/Plat and Conditional Use Permits for the development of approximately 79.7 acres
located west of Vicksburg Lane at Schmidt Lake Road;
The property is more specifically described as:
That part of the Southeast Quarter of the Northwest Quarter and the Southwest
Quarter of the Northeast Quarter of Section 8, Township 118 North, Range 22
West of the Sth Principal Meridian, lying Southerly of the railroad riga-of-way,
according to the United States Government survey thereof, Hennepin County,
Minnesota.
ALSO
The Southeast Quarter of the Northeast Quarter of Section 8, Township 118
North, Range 22 West of the Sth Principal Meridian, except the South 171.2
feet as measured along the East and West lines thereof, also except the North
654.42 feet as measured along the East and West lines thereof, according to the
Government Survey thereof, Hennepin County, Minnesota, EXCEPT the East
33 feet thereof.
ALSO
The North 220.00 feet of the Northeast Quarter of the Southeast Quarter, as
measured along the East and West lines thereof, and the South 171.2 feet of the
Southeast Quarter of the Northeast Quarter, as measured along the East and
West lines thereof, Section 8, Township 118 North, Range 22 West of the 5th
Principal Meridian, EXCEPT the East 33 feet thereof.
ALSO
The South 443.22 feet of the North 663.22 feet, as measured along the But and
West lines of the Northeast Quarter of the Southeast Quartei of Section 8,
Township 118 North, Range 22 West of the 5th Principal Meridian, EXCEPT
the East 33 feet thereof.
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;

NOW, THffitEFORS, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MMESOTA, that it should and hereby does approve
the request of Weston, Hilloway Corp. and Moen Leuer Construction for a Residential
Planned Unit Development Concept Plan, Preliminary Plan/Plat and Conditional Use
Permits, subject to the following conditions:
1. The Concept Plan for Blocks I and 2 and Outlots G, H, and I provides for a
density of 1.70 units based on the zero (0) bonus points and a total of 83
dwelling units for Oudots B through L excluding Outlot F.
2. RPUD Preliminary Plan/Plat and Conditional Use Permit approval has been
granted for Blocks 1 and 2 (the single family section of this PUD). The
remainder of the subdivision shall be platted as outlots.
3. A Sketch Plan has been reviewed for Outlots A and F. Sketch Plan review is
for informational purposes only. Approval of the street layout and the number
of dwelling units has not been granted for Outlots A and F.
4. The Interim Wetland Regulations shall apply to Blocks 1 and 2 and to Outlots B
through L excluding Outlot F. Outlots A and F shall comply with the Wetland
Protection Ordinance.
5. Outlots B, C, D, E and J shall be dedicated to the City for Park Trail purposes.
The deeds for the Outlots shall be given to the City prior to filing the Final Plat
with Hennepin County.
6. The RPUD Final Plan/Plat shall include a 30 -foot the trail outlot on the south
side of Schmidt Lake Road not a 10 -foot outlot as shown on the preliminary
plans. Any narrower dedication must be approved by the Director of Park and
Recreation.
7. The RPUD Final Plan/Plat application shall show the park as an outlot. The
Outlot shall be dedicated to the City for park purposes. The deed for the park
shall be given to the City prior to the filing of the Final Plat with Hennepin
County.
8. Park dedication fees shall be a combination of land dedication and cash. Any
cash fees shall be at the rate In effect at the time of filing the Final Plat with
Hennepin County.
9. An Assessment Agreement regarding the water tower located in Outlot A shall
be filly signed prior to recording the Final Plat.
10. Development standards for Blocks l and 2 shall comply with the standards of
the R -IA section of the Zoning Ordinance

11. Minimum wetland setback for single family lots shall be 25 feet.
12. The RPUD Final Plan/Plat application shall include an approved emergency
vehicle turn around at the end of Schmidt Lake Road.
13. Approval of a Wetland Mitigation Plan prior to the issuance of Smiling permits.
14. The contract for Schmidt Lake Road shall be awarded prior to issuance of
building permits for Lots 24 through 30 Block 1 and Lots 1, 9, 10 and 16 Block
2.
15. A sign shall be placed at the entrance to the subdivision identifying the location
of Schmidt Lake Road. The sign shall comply with the conditions of City
Policy 88-494 regarding development signage showing arterial roads. A sign
permit application shall be approved prior to the issuance of building permits.
16. Perimeter screening shall include the use of six-foot fences as shown on the
Sheet 2, the landscaping plans.
17. Outlots K and L shall be eliminated and the development signage rel -sated to
the entrances of the subdivision off Schmidt Lake Road.
j 18. A Conditional Use Permit is granted for mining and land reclamation for
Outlots A and F. The mining and land reclamation plan shall be in
conformance with the grading plan shown on Sheet 5 of the plans with a
revision date of March 3, 1995. The request meets the Conditional Use Permit
standards.
19. Submittal of a Site Improvement Performance Agreement (SIPA) for the mining
and land reclamation Conditional Use Permit prior to issuance of grading
permits. A SIPA would not be required if the grading plan is incorporated into
the Development Contract.
20. A trail easement shall be provided in the vicinity of Lots 7 and 8, Block 1. The
exact location shall be determined during review of the RPUD Final Plan/Plat-
21. Tie PUD Final Plans shall include fencing adjacent to the Hollydale Golf
Course to limit access to the Golf Course. Cost of the fencing shall be split
between Weston Corporation and Hollydale Golf Course.
22, Drainage from approximately 13 additional acres of this site shall be directed
away from the Hollydale Golf Course, subject to Watershed District approval.
The 13 acres are identified in an agreement between Weston Corporation and
Hollydale Golf Course dated May 1, 1995.

23. Standard Conditions:
A. Compliance with City Engineer's Memorandum except munber 25 D.
B. Removal of all hazardous trees from the property at the owner's
expense.
C. No building permit shall be issued until a contract has been awarded for
sewer and water.
D. Street names shall comply with the City Street Naming Symm.
E. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
stone water drainage facility.
F. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
G. Private driveway access shall be limited to internal public mads and
restricted from Vicksburg Lane and Schmidt Lake Road.
H. Final Plat mylars shall refer to RPUD 95-3.
1. Appropriate legal documents regarding Homeowners Association
documents, covenants and restriction as approved by the City Attorney
shall be filed with the Final Plat.
J. Location and number of fire hydrants shall be approved by the Fire
Division.
K. Submittal of fire flow data with the RPUD Final Plan/Plat.
L. Submission of a Site Improvement Performance Agreement prior to
issuance of building permits for perimeter landscaping.
M. All structures on this site shall be removed prior to issuance of building
permits.
N. The developer shall install wetland monumentation delineating the
wetland within each lot. The monuruent design shall be approved by the
Community Development Department.
O. Appropriate legal documents regarding Homeowners Association
documents, covenants and restriction as approved by the City Attorney
shall be filed with the FInal Plat. Specific reference shall be made to the
maintenance of common open space, fencing perimeter landscaping, and
the landscaping in street islands.
P. The Developer shall hold the City and its officers, employees, and
agents harmless from claims made by itself and third parties for damages
sustained or costs incurred resulting from plat approval and
development. The Developer shall indemnify the City and its officers,
employees, and agents for all costs, damages, or expenses which the
City may pay or incur in consequence of such claims, including
attorneys' fees.
