WHBRBAS, Janco Inc. has requested approval of a Mixed Planned Unit Development
Concept Plan, Preliminary Plan/Plat and Conditional Use Permit for the development
of approximately 38.9 acres located at the southeast corner of Old Rockford Road and
Peony Lane;
The property is more specifically described as:
That part of the Northeast Quarter of the Northeast Quarter of Soction 18,
Township 118, Range 22, lying south of Rockford Road and Bast of Peony
Lane, formerly State Highway No. 101, EXCEPT the following described tract:
Commencing at the intersection of the center line of Rockford Road and the
t Hast line of the Northeast Quarter of the Northeast Quarter of Section 18,
Township 118, Range 22; thence south along said Bast line 435 feet; thence
west and parallel with the north line of said Northeast Quarter of the Northeast
Quarter of said Section 18, 385 feet; thence north and parallel with the east line
of the Northeast Quarter of the Northeast Quarter of said Section 18, to the
center line of Rockford Road; thence southeasterly along the center line of
Rockford Road to the point of beginning. Also that part of the North Half of
the Southeast Quarter of the Northeast Quarter of said Section 18, lying easterly
of State Highway No, 55 and Peony Lane, BXCMYT from the above described
tracts the following described property; Beginning at a point in the easterly line
of Peony Lanc, distant 909.07 feet southerly, measured along said easterly line,
from the southerly line of Rockford Road; thence easterly at right angles to said
easterly line, a distance of 104 feet; thence routheasterly deflecting to the right
67 degnxrs 14 minutes 50 seconds a distance of 380.63 feet; thence
%outhwestecly deflecting to the right 67 degrees 14 minutes 38 seconds a
distance of 104 feet to the northeasterly line of State Highway No. 55; thence
northerly along the light of way lines of State Highway No. 55 and Peony Lane
to the point of beginning, Hennepin County, Minnesota.

County, Minnesota, described as follows: Commencing at the Intersection of

of the Northeast Quarter, thence south along said east line of the Northeast
( Quarter of the Northeast Quarter 435 feet; thence west and parallel with the
north line of said Northeast Quarter of the Northeast Quarter 385 feet; thence
north and parallel with the east line of said Northeast Quarter of the Northeast
Quarter to the center line of the Rockford Road; thence southeasterly along the
center line of the Rockford Road to the point of beginning, EXCEPT that part
described as follows: Commencing at a point on the east line of said Northeast
Quarter where it intersects with the centerline of the Rockford Road, said point
being 629.85 feet south of the northeast corner of said Northeast Quarter;
thence south along said east line of the Northeast Quarter 217.80 fed; thence
west at right angles 100 feet; thence north at right angles 243.47 feet to the
center line of the Rockford Road; thence 103.20 feet along the center line of
Rockford Road to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CTIY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request of Janco Inc. for a Mixed Planned Unit Development Concept Plan,
Preliminary Plan/Plat and Conditional Use Permit, subject to the following conditions:
1. The Concept Plan provides for a density of 3.95 units per acre based on the zero
(0) bonus points for a total of 144 units.
2. The approved MPUD shall be in compliance with the plans dated March 21,
1995 except as amended by this Resolution.
3. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of recording the Final Plat in
combination with land dedication for trail outlots. The developer shall be
reimbursed for the cost of paving the trail along Old Rockford Road.
4. MPUD Concept Plan approval only is granted for Lot 9, Block 4.
5. The MPUD Final Plan/Plat shall show a ten -foot trail outlot on the south side of
Old Rockford Road.

6. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits
and filing of the Final Plat.
7, The developer shall install wetland monumentation delineating the wedind
within each lot. The monument design shall be approved by the Community
Development Department.
8. The development shall comply with the proposed landscaping plan and shall be
revised to provide full screening of the parking spaces adjacent to 41st. Ave. N.
9. The contract for the sanitary sewer shall be awarded prior to recording the final
plat with Hennepin County.
10. The final plat shall include the dedication of additional rght -of--way for Peony
Lane.

12. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's
expease.
C. No building permit shall be issued until a contract has been awarded for
sewer and water.
D. Stmt names shall comply with the City Strome NaminE System.
B. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
F. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
G. Private driveway access shall be limited to internal public coatis and
restricted from T. H. 55.
H. Final Plat mylars shall refer to MPUD 95-1.
1. Appropriate legal documents regarding Homeowners Association
documents, covenants and restriction as approved by the City Attorney
shall be filed with the Final Plat.
J. Location and number of fire hydrants shall be approved by the Fire
Division,
K. Compliance with Fire Division regulations regarding fire lane
requirements and fire suppression systems
L. The multi -family structures shall proved a fico extinguishing system if
the site cannot meet the minimum hoselay requirements.
M. Submission of a Site Improvenment Performance Agreement prior to
issuance of building permits.
