HomeMy WebLinkAboutCity Council Resolution 1995-294F CITY OF PLYMOUTH RESOLUTION 95- 294 APPROVING A RESIDENTIAL PLANNED UNIT DEVELOPhUM PRELIMINARY PIAN/PLAT, CONDITIONAL USE PERMIT AND VARIANCE FOR I&D 284 (WAYZATA) AND THE CITY OF PLYMOUTH FOR PROPERTY LOCATED NORTHWEST OF THE INTERSECTION OF PEONY LANE AND THE 800 I= RAILROAD (94131) WHEREAS, ISD 284 and the City of Plymouth have requeaead approval of a Residential Planned Unit Development Preliminary Plan/Plat, Conditional Use Permit and Variance for the development of 161 acres located northwest of the intersection of Peony Lane and the Soo Line Railroad; Parcel 1: The Southwest quarter (SW 1/4) of the Northeast Quarter (NE 1/4) of Section Seven (7), township One Hundred Eighteen (118), Range Twenty -Two (22), Hennepin County, Minnesota, according to the Government Survey thereof. (Abstract) Parcell: All of the Northwest Quarter of the Northeast Quarter of Section 7, township 118, Range 22, except the North 990.0 feet thereof, according to the Government survey thereof, Hennepin County, Minnesota. (Torrens) Parcel 3: The East 1/2 of the East 1/2 of the Northwest 1/4, in Section 7, Township 118 North, Range 22 West of the 5th Principal Meridian according to the Government Survey thereof, Hennepin County, Minnesota. Parcel 4: The West 1/2 of the East 1/2 of the Northwest 1/4 of Section 7, Township 1180 Range 22, according to the Government Survey thereof, Hennepin County, Minnesota. (Abstract) Parcel 5: That part of the East 1/2 of the East 1/2 of the Southwest 1/4 of Section 7, Township 118 North, Range 22 West of the 5th Principal Meridian, according to the Government Survey thereof, which lies north of the northerly right of way line of Minneapolis, St. Paul and Sault Ste. Marie Railroad Company. Subject to an easement for road purposes and for ingress and egress over the North 60 feet of above land, Said Northwest 1/4 of said Section, and is to connect with an easement for the same purposes over the North 60 feet of the West 1/2 of the Southeast 1/4 of said Section, as shown in Deed Doc, No. 963463, Files of Registrar of Titles. Parcel 6: That part of the West 1/4 of the Southeast 1/4 of Section 7, Township 118, Range 22, according to the Government Survey thereof, which lies North of the northerly right of way line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad Company. E • Parcel 7: The East 112 of the West 1/2 of the Southeast Quarter of Section 7, Township l is North, Range 22 West of the Fifth Principal Meridian, which lies North of the northerly right of way line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad Company. Subject to the rights of the public in Peony Lane over the Easterly 33 feet of Parcel 7. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, IMMWORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of ISD 294 (Wayzata) and the City of Plymouth for a Residential Planned Unit Development Preliminary Plan/Plat, Conditional Use Permit and Variance, subject to the following conditions: 1. The RPUD shall be in compliance with the plans dated April 10, 1995 except as amended by this Resolution. In particular, none of the lighted athletic facilities may be constructed until the School District demonstrates that the lighting meets City requirements. 2. A Conditional Use Permit is hereby granted for a high school in an R-lA District. 3. A Variance is granted from the Subdivision Code for the creation of a lot without frontage on a public street. The Final Plat shall show cross easements for public access to Lot 2, the City Playfield. 4. A Variance is granted from the Fire Code regarding location of fire lanes. 5. Park dedication will be addressed In the joint powers agreement between the City and the School District. 6. The RPUD Final Plan/Plat shall show an eight -foot park trail running the entire length of the ring road and connecting to another eight -foot trail running north/south along the west side of Peony Lane, 7. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits and filing of the Final Plat. 9. Installation of wetland buffer monumentation as appropriate. The monument design shall be approved by the Community Development Department. 9. Compliance with all statements in the Record of Decision for the Environmental Assessment Worksheet. • • 10. ISD 284 shall convey drainage and ponding easements to the City that will encumber all wetlands on the site and Elm Creek. 11. ISD 284 shall mitigate the wetland loss at a minimum 2:1 replacement natio. 12. The proposed development shall include construction of on-site basins for storm water treatment that meet the National Urban Runoff Program (NURP) water quality guidelines as well as the MPCA's Best Management Practices Manual and City of Plymouth's water quality requirements. 13. ISD 284 shall sign an agreement with the City for future maintenance of the storm water treatment ponds in accordance with standard City policy. 14. Strict adherence to the City's Erosion Control Ordinance shall be met. 15. The Final Plan shall designate an area for recycling in addition to trash compaction. 16. The Final Plan shall show three loading docks 60 -feet in length and 12 -feet in width. 17. The final landscaping plan shall be approved by the City Forester. 18. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees on the construction site at the owner's expense. C. If permits am required before the City awards contracts for sanitary sewer, watertmin and Peony Lane, the School District shall enter into a "Hold Harmless Agreement" with the City. D. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. B. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. F. Any signage shall be in compliance with the Zoning Ordinance. 0. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. H. Final Plat mylars shall refer to RPUD 95-4. I. Submittal of fire flow data with building permit application. J. Compliance with Fire Division regulations regarding Fire Department connection, fire lane requirements and fire suppression systems. K. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. Approved by the City Council on May 16, 1995. • • ( STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
