RESOLUTION NO. 95 - 291
PARTIAL RELEASE OF DEVELOPMENT CONTRACT
BASS CREEK BUSINESS PARK ADDr110N AND
BASS CREEK BUSINESS PARK 3RD ADDITION
WHEREAS, the City of Plymouth and Opus Corporation enteral into Development
Contract 88146 dated May 1, 1989, for the plat of Bass Lake Corporate Center First
Addition, as referenced in that certain certified copy of Resolution of the City of
Plymouth recorded in the office of the Hennepin County Recorder on May 31, 1989, as
Document No. 5539085; and
WHEREAS, The City of Plymouth, Opus Corporation, and Schneider (USA), Inc. have
entered into that certain unrecorded Development Contract 89061 dated June 12, 1990, for
the plat of Bass Creek Business Park Addition; and
WHEREAS, the City has been requested to grant a release of these Development
Contracts for Lots 1 and 2, Block 1, Lots 1, 2, and 3. Block 2, Lot 1, Block 3, Bass
Creek Business Park Addition, Lot 1, Block 1 and Oudot A, Bass Creek Business Park
( 3rd Addition.
NOW, TMMUORB, BE IT HEREBY RESOLVE by the City Council of the City of
Plymouth:
1. With the exception of levied and pending special assessments, if any, Lots 1
and 2, Block 1, Lots 1, 21 and 3, Block 2, Lot 1, Block 3, Bass Creek Business
Park Addition, Lot 1, Block 1 and Outlot A, Bass Crock Business Park 3rd
Addition is hereby released from the financial obligations assumed by the
Developers in conjunction with the development of public improvements in the
plats.
2. Ilds release does not waive any fees which are required to he paid as a part of
the building permit application.
3. The Mayor and City Manager are authorized to sign the partial release.
