CITY OF PLYMOUTH
RESOLUTION NO. 9S - 282
APPROVING FILLING WETLANDS
AND THE WETLAND REPLACEMENT PLAN FOR
PLYMOUTH PONDS, MOEN LEDER CONSTRUCTION, INC.
WHEREAS, the developers of The Moen Leuer Construction, Inc. propose to fill wetlands for
the construction of a facility; and
Wh9MEAS9 there are no reasonable alternatives for the location of the facility; and
WIMUM, a Mitigation Plan was prepared replacing the wetlands in kind at a 2 to 1 ratio
which is required by the Wetland Conservation Act of 1991; and
WHEREAS, the Replac5ment Plan meots the requirements of the Wetland Act..
NOW, THBRE~ORB, PE IT HMMY RESOLVED BY THE CITY COUNC L OF THE
CITY OF PLYMOUTH, I UNNESO'I'A: That the Mayor is authorized to execute the LGU'S
Findings of Fact, approving the filling of wetlands and the Replacement Plan for wetland
mitigation in Block 1; Lots 1, 2, 3, and Outlot A &B, subject to the followi conditions:
1. The replacement wetland must be monitored by h.oen Leuer Construcrdon, Inc. for a five
(5) year period from the date of completion.
2. The developer's wetland colasultant shall submit an annual monitoring report to the city of
i lymouth on cite anniversary date of the completion of the replaa:ment wetland for a
period of five (5) years containing information required in WC A rule 8420.0620.
3. The replacement wetland must be constructed concurrently with site grading.
4. Moen Issuer Construction, Tnc. shall submit a letter of credit in the amount of the cost of
the Replacement Plan. The iettvr of credit shall be. fur a period of five (5) years. If during
the fiscal year period the replacement wetland does not perforin as proposed in the plan,
woric as necessary shall be underi:aken by the developer to bring it into conformance.
5. Becauie of the steer slopes sumunding the mitigated wetland #2 and on Nil section of
wetland #1, the applicant shall install temporary eros -on control blankets on all of these
slopes to insure proper development of the seeded vegetation and to prevent erosion..
6. A deed creating a mstrirtive covenant running; with the land for the replacement area must
be Tvorded. The deed OmIl be submitted to the. City for approv4l before recording.
