HomeMy WebLinkAboutCity Council Resolution 1995-275CITY OF PLYMOUTH RESOLUTION No, 95 - 275 AUTHOR>ZD(G THE VACATION OF ( A PORTION OF FIiRNBROOH LANE (ALSO SHOWN AS 4TH AVENUE) RIGHT-OF-WAY IN HARBOR PLACE ADDITION WHEREAS, a petition was received to vacate a certain portion of Fernbrook Lane (ala known as 4th Avenue) in Harbor Place Addition; and WHEREAS, aid petition was signed by a majority of the owners of the laud abuating the area proposed to be vac ded; and WHEREAS, a public bearing with respect to said vacation was acbeduled for May 2, 1995 In accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of acid bearing was published and posted two weeks prior to the meeting of May 2, 1995; and VAREREAS, all property owner adjacent to the proposed vacation were duly nodibd toy mail; and WHEREAS, the Council did hold a public bearing on May 2, 1995, to inform any and all ieserested parties relevant to the vacation of a portion of Fanbrook Lane (ala known u 4th ( Avenue) in Harbor Place Addkmr ; and WHEREAS, it was determined by the City Council that aid casemate were not needed for i purposes; MW, THEREFORE, BB IT HEREBY RESOLVED BY THE CITY COUNC L OF THE CITY OF PLYMOUTH, IOTA: That the following portion of Fen6 ook Lane (ala known as 4th Avenue) rigbt-of-way in Hubor Pleoe Addition be vacated: Tbat part of Fernbrook Lon (ala known as 4th Avenue) lying nortiroastedy of the southeasterly extension of the easterly right-of-way Wore of Olader Laae u dedicated in the plat of "Harbor Place,' and on file or of record, Hem*n Corny, MN FURTHER, that aM vacation shall not affect the autbodty of any person, corpoutiom, or municipality owning or controlling the electric or telephone poles and tiles, gas and sewer lines, water pipes, mains and bydrants thereon or thereunder, to continue maintaining the ane, to easter upas web way or portion thereof vacated to repair, replace, remove other attend thereto. FURTHER, wbjea to a dralnage and utility essaneM over, under, and across all of vacated Fembrook Lane (ala known as 4th Avenue) street night -of -way. FURTHER, the bituminous will rot be removed until this stmt becomes part of the Reconstruction prornm unless Ilse adiacent property owners are responsible for the cost.
