WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CM OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Janco Inc. for a Residential Planned Unit Development Concept Plan, Preliminary PlaNPiat and Conditional Use Permit, subject to the following conditions: 1. The Concept Plan provides for a density of 2.7 units bases on the zero (0) bonus points, minus two for overall project size and plus two bonus points for open space. A total of 70 units are approved for this site. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat, 3. The RPUD Final Plan/Plat shall include provisions for a park trail connecting Xenium/Vinewood Lane to Northwest Blvd. 4. The RPUD Final Plan/Plat shall show an eight-:oot trail on the west side of Xenium/Vinwood Lane. The trail shown on the east side of Xenium/Vinwood Lane is not required and would not be maintained by the City. 11 File 941599 Page 3 5. Development Standards: A. 25 -foot front yard setback to street right-of-way B. 20400t setback between buddings C. 25 -foot setback to the subdivision property line D. 50 -foot setback to Northweit Blvd. right-of-way & 25 -foot wetland setback 6. Minimum lot size shall be 2,950 slauare feet. 7. Maximum lot coverage shall be Su percent. 8. Approval of a Wetland Mitigati. ) .i Plan prior to the issuance of grading permits and filing of the Final Plat. 9. The developer shall install raetland monumentation delineating the wetland within each lot. The monument design shall be approved by the Community Development Department. 10. The contract for XeniumNinewood Lane shall be awarded prior to issuance of building permits. 11. Lots 1 through 16, Block 1 shall be platted as outlots until Xenium Lane right- of-way is vacated and adde,; to the adjoining properties. 12. The RPUD Final Plan/Plat shall be consistant with the Preliminary Plan/Plat submitted at the March 22, 1995 Planning Commission meeting that relocated lots 17 and 18, Block 1 to the vacinity of lots 32 and 34, Flock 1. 13. The final landscaping plan shall include plantings along the north edge of the site west of Vinewood Lane to provide screening of the auto dealership. 14. Prior to the dedication of the outlot to the City for open space purposes, the developer shall complete Phase I Environmental Audit (and a Phase II Audit if deemed necessary by the Phase I Audit), and complete all required cleanup work on the site. 15. The cul-de-sac shall be posted "!eft turns prohibited onto Northwest Boulevard at all times". Staff is directed to negotiate with Hennepin County to attempt to obtain reasonable and necesrry signage to prohibit left turning movements onto the cul-de-sac from northeriy traffic on Northwest Boulevard for the safety of the residents in and around the area. • File 941599 Page 4 16. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permit shall be issued until a contract has been awarded for sewer and water. D. Street names shall comply with the City Street Naming System. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. F. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. G. Private driveway access shall be limited to internal public roads and restricted from Northwest Blvd., Vinewood Lane and Xenium Lane. H. Final Plat mylars shall refer to RPMT 5.S-''21. I. Appropriate legal documents reganlin r ameowners Association documents, covenants and restriction as approved by the City Attorney shall be filed with the Final Plat. J. Location and number of fire hydrants shall be approved by the Fire Division. K. Compliance with Fire Division regulations regarding fire lane requirements and fire suppression systems L.
