HomeMy WebLinkAboutCity Council Resolution 1995-239• CITY OF PLYMOUTH RESOLUTION 95 - 239 APPROVING LOT DIVISIONICONSOLIDATION ANr VARIANCES FOR RAAINNES AND BUZZEr r _R (95010) WHEREAS, an application has been filed by Richard Haines and David Buzzelle which requests approval of a Lot Division/Consolidation and Variances to divide and consolidate certain parcels of land generally located at 10220 South Shone Drive and 10222 South Shore Drive (Parcel A and Parcel B respectively), legally described on Attachment One, attached hereto and hereby made a part hereof, and WHEREAS, the proposed lot arrangement for which the Lot Division/Consolidation is sought is as legally described on Attachment Two, attached hereto and hereby made a part hereof, and WHEREAS, the Planning Commission has fully considered the request for the Lot Division/Consolidation and Variances, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF ( THE CITY OF PLYMOUTH, NIINNBSOTA, that it should and hereby does approve the Lot Division/Consolidation and Variances subject to the following conditions: 1. Submittal of deed for South Snore Drive right-of-way (Tracts C, D, and E) as apprcved by the City Engineer prior to filing of the Lot Division/Consolidation. 2. Submittal of ponding easement document as approved by the City Engineer for all land below the 100 year flood plain elevation for Medicine Lake (889.7 feet) prior to filing of the Lot Division/Consolidation, 3. Submittal of drainage and utility easement documents as approved by the City Engineer prior to filing of the Lot Division/Consolidation. 4. Submittal of park dedication fee for Parcel F (Tract F) as described on Attachment Two, prior to filing of the Lot Division/Consolidation. Adopted by the City Council on April 4, 1995. 0 Resolution No. 95- 239 That part of Government Lot 4, Section 25, Township 118, Range 22, described as follows: Commencing at a point in the north line of the right-of-way of the Minnesota Western Railroad Co., which railroad right-of-way is descriW, as follows: A strip, piece or parcel of land 100 feet in width across Government Lot 4, Section 25, Township 118, Range 22 being 57 feet of said width on the Southerly side and 43 feet on the Northerly side of the following described line: Commencing at a point in the South line of the Southeast Quarter of Section 25, Township 118, Range 22, which point is 964 feet Bast of the Southwest corner of said Southeast Quarter of said Section; thence North 71 degrees 42 minutes West 500 feet; thence on a 3 degree 15 minute curve to the left a distance of 500.2 feet more or less to the West line of said Southeast Quarter of Section 25. For the purposes of this description the South line of the Southeast Quarter of Section 25 is assumed to be a due Bast and West line; where the same is intersected by a line cunning north and south parallel with and distant 150 feet east of the west line of said Government Lot 4; thence in a northeasterly direction along the North line of said railroad right-of-way to a point where the same is intersected by a line running north and south parallel with and distant 200 feet east of the west line of said Government Lot 4; thence North along the last mentioned parallel line to the Northwesterly line of said Government Lot 4; thence in a southwesterly direction along the northwesterly line of said Government Lot 4 to its intersection with a line running north ani south parallel with and distant 150 feet east of the west line of said Government Lot 4; thence south on a line which is parallel to the west line of Government Lot 4, and distant 150 feet east thereof to the point of beginning and situate in Hennepin County, Minnesota. All that part of Government Lot 4 of Section 25, Township 118, Range 22, lying West of a line running North and South parallel with and distant 150 feet Bast of the West line of said Government Lot 4 and the extension thereof and Bast of a line running North and South parallel with and distant 75 feet Bast of the West line of said Government Lot 4 and the extension thereof and North of the North line of the right- of-way of the Minnesota Western Railroad Co. which right-of-way is described as follows: A strip, piece or parcel of land 100 feet in width across Government Lot 4 in Section 25, Township 118, Range 22, being 57 feet of said width on the Soitherly side and 43 • Resolution No. 95- 239 feet on the Northerly side of the following described line: Commencing at a point on the South line of the SE 1/4 of Section 25, Township 118, Range 22, which point is 964 feet Bast of the Southwest corner of said SB 1/4 of said Section; thence North 71 degrees 42 minutes West 500 feet; thence on a 3 degree 15 minute curve to the left a distance of 500.2 feet more or less to the West line of said SB 1/4 of Section 25. For the purpose of this description the South line of the Southeast Quarter of Section 25 is assumed to be a due Bast and West line. Resolution No. 95 - The metes and bounds description of this Registered Land Survey No. is as follows: That part of Government Lot 4, Section 25, Township 118, Range 22, described as follows: Commencing at a point in the North line of the right-of-way of the Minnesota Western Railroad Co., which right-of-way is described as follows: A strip, piece or panel of lad 100 feet in width across Government Lot 4, Section 25, Township 118, Range 22, being 57 feet of said width on the Southerly side and 43 feet on the Northerly side of the following described line: Commencing at a point in the South Me of the Southeast Quarter of Section 25, Township 118, Range 22, which point is 964 feet Bast of the Southwest comer of said Southeast Quarter of said Section; thence North 71 degrees 42 minutes West 500 feet; thence on a 3 degree 15 minute curve to the left a distance of 500.2 feet more or less to the west line of said Southeast Quarter of Section 25. For the purpose of this description the South line of the Southeast Quarter of Section 25 is assumed to be a due Past and West line; where the same is intersected by a line running north and south parallel with and distant 150 feet east of the west line of said Government Lot 4; thence in a Northeasterly direction along the North line of said railroad right-of-way to a point where the same is intersected by a line running North and South parallel with and distant 200 feet east of the west line of said Government Lot 4; thence North along the last mentioned parallel line to the Northwesterly line of said Government Lot 4; thence in a southwesterly direction along the northwesterly line of said Government Lot 4 to its intersection with a line running north and south parallel with and distant 150 feet east of the west line of said Government Lot 4; thence south on a line which is parallel to the west line of Government Lot 4, and distant 150 feet east thereof to the point of beginning.
