HomeMy WebLinkAboutCity Council Resolution 1995-214• CITY OF PLYMOUTH RESOLUTION 93- 214 AT .E NORTHWEST QUADRANT • • PEONY LANE AND COUNTY ROAD (OLD ROCKFORD ROAD)(94162) WHEREAS, Lundgren Bros. have requested approval of a Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for the development of approximately 71.78 acres located at the northwest quadrant of Peony Lane and County Road 9 (Old Rockford Road); The property is mom specifically described as: That part of the West 1/4 of the Southeast 1/4 of Section 7, Township 118, Range 22, according to the Government Survey thereof, which lies North of Hennepin County Road No. 9, except Railroad Hennepin County, Minnesota. The Bast 1/2 of the West 1/2 of the Southeast Quarter of Section 7 and all of that part of the Bast 1/2 of the Northwest Quarter of the Northeast Quarter of Section 18 lying and being Northerly of the highway now existing and running through the last above described premises in an Easterly and Westerly direction, all in Township 118 North, Range 22 West of the Fifth Principal Meridian. Subject to an easement in favor of the Minneapolis and Pacific Railway Company, its successors and assigns and to any rights or interests held by it in said premises by reason of deed of record in Book 226 of Deeds, page 136. (Torrens Property --Cert. No. 772427) That part of the Bast 1/2 of the Bast 1/2 of the Southwest 1/4 lying North of the center line of Hennepin County Road No. 9 in Section 7, Township 118 North, Range 22 West of the Sth Principal Meridian, according to the Government Survey thereof. Subject to an easement for road purposes and for ingress and egress over the North 60 feet of above land. Said easement is for the benefit of and appurtenant to, the Bast 1/4 of the Northwest 1/4 of said Section, and is to connect with an easement for the same purposes over the North 60 feet of the West 1/2 of the Southeast 1/4 of said Section, as shown in deed Doc. No. 963463, Files of Registrar of Titles. Also subject to a railroad right of way of the Minneapolis, St. Paul and Sault Ste. Marie Railway Company, a corporation, over and across said premises and being upon a strip of land described as follows: A strip of land 100 feet wide the same being SO feet in width on each side of the center be of the railway of Minneapolis, St. Paul and 1 Sault Ste. No. 772427) File 940579 Page 2 WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE LT HMU BY RESOLVED BY THE C2TY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Lundgren Bros. for a Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all hazardous trees from the property at the owner's expense. 3. No building permit shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 7. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 8. Private driveway access shall be limited to internal public roads and restricted from County Road 9 (Old Rockford Road) and Peony Lane. 9. Screening along County Road 9 (Old Rockford Road) and Peony Lane shall be provided in accordance with the approved Landscape Plan. 10. Final Plat mylars shall refer to RPUD 95-1. 11. Appropriate legal documents regarding Homeowners Associatiou documents, covenants and restriction as approved by the City Attorney shall be, filed with the Final Plat. Specific reference shall be made to the maintenance of the active recreational features and the landscaping in street islands. File 940579 Page 3 12. Minimum lot size shall be 9,000 square fed. 14. Maximum lot coverage shall be 25 percent. 15. Approved minimum lot width shall be 7S feet. 16. Location and number of fire hydrants shall be approved by the Fire Division. 17. Perimeter monuments and kiosks shall be in conformance with the approved RPUD Preliminary Plan. ( 18. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. The agreement shall include "common" landscaping and buffer monumentation. 19. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits and submission of PUD Final Plan/Plat. 20. The developer shall install wetland monumentation delineating the buffer boundary within each lot. The monument design shall be approved by the Community Development Department. 21. The RPUD final plat shall not be recorded prior to the awarding of the contract for the trunk sanitary sewer and the development contract will provide that the developer shall hold the City harmless should the contract not be awarded. 22. The contract for Peony Lane shall be awarded prior to submission of a RPUD Final Plat for any portion of the project requiring access form Peony Lane. 23. The contract for the trunk sanitary sewer shall be awarded prior to construction begins on the interior sanitary sewer. 24. Lot 1 through 7 and Lot 17 Block 6 and Lot 2 Block 7 shall be platted as oudots until Peony street construction is completed. File 94057, Page 4 ( 25. The driveway for Lot 1, Block 4 shall be looted adjacent to the common lot line with Lot 2, Block 4. 26. The RPUD Final Plan/Plat sball show that Lots 17, 18, and 19, Block 3 have a usable back yard in addition to the wetland buffer. 27. The two median islands in the right-of-way of Queensland Lane at Peony Lane &ball be combined into one island. Access from 45th Ave. N. onto Queensland Lae &ball be restricted to right -in and right -out movements. 28. The MW grading plan Shall not include the berm shown at the intersection of 45th. Ave. N. at County Road 9. Approved by the City Council on March 21, 1995.
