WHEREAS, the City Council has approved the Final Plat and Development Contract
for Fernbrook Woods 2nd Addition located west of Fembrook Lane at Schmidt Lake
Road;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, b1INNESOTA, that it should and hereby does approve
the following to be met, prior to recording of, and related to said plat;
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's expense.
3. No building permits shall be issued until a contract has been awarded for the
construction of municipal sewer and water.
4. Payment of park dedication fees -in -lieu of dedication with appropriate credits in
an amount determined according to verified acreage and paving costs and
according io the Dedication Policy in effect at the time of filing the Fhial Plat
with Hennepin County, in combination with land dedication for Outlots A, B,
C, D, and E.
S. The developer is responsible for grading all trail outlots and providing suitable
ground cover.
6. Street names shall comply with the City Street Naming System.
7. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open storm
water drainage facility.
B. No building permits to be Issued until the Final Plat is filed and recorded with
Hennepin County.
9. No yard setbacks variances are granted or implied.

10. Private driveway access shall be limited to internal public roads and shall be
( prohibited from Fernbrook Lane and Schmidt Lake Road.
11. Any signage shall be in compliance with the Ordinance.
12. A sign shall be placed in the development notifying potential home buyers that
Schmidt Lake Road will be extended through the development.
13. The deed for Outlots A, B, C, D, and B shall be given to the City of Plymouth
prior to recording the Final Plat.
14. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
15, The Development Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
16. No building permits shall be issued for Lot 1, Block 1, until a contract has been
awarded for construction of Schmidt Lake Road.
17. Submittal and approval of a transitional screening and berming plan for the area
adjacent to Schmidt Lala Road, prior to filing of the Final Plat with Hennepin
( County.
18. Submittal of a Site Improvement Performance Agreement prior to issuance of
building permits.
