CITY OF PLYMOUTH
RESOLUTION NO. 95 - 153
AUTHORIZING CONDEMNATION PROCEEDINGS FOR A PORTION OF THE
VACATED LARCH LANE SOUTH OF THE CUL-D&SAC IN RAPPAPORT
ADDITION
WHEREAS, Tract F previously had public access to the city streets via Larch Lane; and
WHEREAS, the vacation of a portion of Larch Lane allowed Hennepin County to assign
ownership of the entire portion of the vacated Larch Lane to the adjoining property, Lot 6,
Block 2 of Rappaport Addition, thereby denying public access to Tract F of Registered Land
Survey No. 599; and
WHEREAS, it was not the intention of the City to deny said public access to Tract F; and
WHEREAS, it is necessary, right, and proper for the City to reacquire said public access to
Tract F for both emergency vehicles and private ingress and egress; and
WHEREAS, the use of Mian, SU1. Sec. 117.042 (1988), so-called "Quick -Take" statute, will
enable the City to reacquire said access in a timely manner;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCEL OF THE
CITY OF PLYMOUTH, WNNESOTA: That the City Attorney is hereby authorized to
commence condemnation pioceedings utilizing said "Quick -Take" statute to reacquire a portion
of the vacated Larch Lane Adjacent to 1Ymct F, Registered Land Survey No. 599.
Lot 6, Block 2, Rappaport Addition, Hennepin County, Minnesota including the
adjacent part of the vacated stre it.
A permanent easement for public street and utility purposes over, under, across, and
through that part of the vacated adjacent street (Larch Lane) lying north of the
following described line: Commencing at the southeast corner of Lot 6, Block 2,
Rappaport Addition, Hennepin County, Minnesota; thence on an assumed bearing of
north 22 degrees 27 minutes 50 seconds west along the east line of said Lot 6 a distance
of 109.61 feet to the point of beginning of the line to be described; thence easterly to a
point on the easterly line of said vacated Larch Lane, distant 117 feet northeasterly
from the southeast corner of Rappaport Addition and said line there terminating.
