CITY OF PLYMOUTH
( RESOLUTION NO. 95 - 152
AUTHORIZING CONDEMNATION PROCEEDINGS
VICKSBURG LANE - COUNTY ROAD 47 TO NORTH CITY LIMITS
CITY PROJECT NO. 431
WHEREAS, the City of Maple Grove in cooperation with the City of Plymouth has
undertaken City Project No. 431; and
WHEREAS, in order to construct the improvements, certain permanent and temporary
easements am required; and
WHEREAS, the City Council finds it necessary. proper, and expedient in the i.'uprests
of the public health, convenience and general welfare of the citizens of the City of
Plymouth for the City to acquire said easements; and
WHEREAS, the City Council finds that the construction schedule for said public
project makes it necessary to acquire title to and possession of the easement interests
prior to the filing of the final report of the condemnation commissioners to be
appointed by the district court; and
WHEREAS, the use of Him. M. Sec. 117.042 (1988), so-called "Quick -Take"
statute, will enable the City to timely acquire the required lands;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA: That the City Attorney is hereby
authorized to commence condemnation proceedings utilizing said "Quick -'fake" statute
for City Project No. 431 for the following described easement within the following
described parcel:

That part of the northwest 114 of the northwest 114 of Section 4,
Township i l8, Range 22, Hennepin County, MN lying north of Hennepin
County Highway No. 43, Plat 13, according to the recorded plat thereof.

A perpetual easement for public roadway and utility purposes over,
under, across, and through that part of the above described property lying
westerly of a line run parallel with and distant 60 foot easterly of a line

described as follows: Commencing at the southeast corner of the
northeast 1/4 of Section 32, Township 119, Range 22, Hennepin County,
MN thence north 00 degrees 42 minutes 07 seconds east, assumed
bearing, along the east line of said northeast 1/4 438.11 feet to the point
of beginning of the centerline to be described; thence northwesterly
411.01 feet along a non-tangential curve concave to the northwest having
a radius of 739.30 feet and a central angle of 31 degrees, 51 minutes, 11
seconds, the chord of said curve bears south 21 degrees, 07. minutes, 50
seconds west; thence south 36 degrees, 58 minutes, 26 seconds west,
tangent to said curve, 401.52 feet; thence southerly 940.65 feet along a
tangential, curve concave to the east having a radius of 739 30 feet and a
central angle of 72 degrees, 54 minutes, 00 seconds; thence south 35
degrees, 55 minutes, 35 seconds east, tangent to said curve, 639.80 feet;
thence southerly 477.42 feet along a tangential curve concave to the west
having a radius of 739.30 feet and a central angle of 37 degrees, 00
minutes, 01 seconds; thence south 01 degrees, 04 minutes, 26 seconds
west, tangent to said curve, 1057.77 feet and said centerline there
terminating.
