( AUTHORING THE VACATION OF
DRAINAGE AND UTII.ITY FASEN92 'S
AND DRAINAGE EASEMENT FOR PONDING PURPOSES
LOT 1, BLOCK 1 AND OUTIOT A, OAKDALE WEST THIRD ADDITION
WHEREAS, a petition was received to vacate drainage and utility easements and drainage
easement for ponding purposes within Lot 1, Block 1 and Outlot A, Oakdale West Third
Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for February 7, 1995 in
accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of February 7, 1995; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
( WHEREAS, the Council did hold a public hearing on February 7, 1995 to inform any and all
interested parties relevant to the vacation of drainage and utility easements and drainage easement
for ponding purposes within Lot 1, Block 1 and Oudot A, Oakdale West Third Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, TORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That the following drainage and utility easements and
drainage easement for ponding purposes be vacated:
The drainage and utility easements and drainage easement for ponding purposes
within Lot 1, Block 1 and Outlot A, Oakdale West Third Addition according to the
plat thereof on file or of record in the office of the Registrar of Titles, Hennepin
County, MN.
Adopted by the City Council on February 7, 1995.
