RESOLUTION NO. 9S -108
( AUTHORIZING THE VACATION OF
A PORTION OF 41ST AVENUE RIGHT-OF-WAY
PLYMOUTH OAKS ADDITION
WHEREAS, a petition was received to vacate a portion of 41st Avenue right-of-way in Plymouth
Oaks Addition; and
WH R]EjAS, said petition was signed by a majority of the owners of the land abutting the ars
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for February 7, 1995 in
accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of February 7,1995; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the Council did held a public hearing on February 7, 1995 to inform any and all
interested parties relevant to th, vacation of a portion. of 41st Avenue right-of-way in Plymouth
Oaks Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, WNNESOTA: That the following portion of 41st Avenue right-of-way in
Plymouth Oaks Addition be vacated:
That part of 41st Avenue North which lies southerly and southeasterly of a line
which is parallel with and 50.00 feet southeasterly of the southeasterly boundary of
Lot 9, Block 5, Plymouth Oaks Addition, according to the recorded plat thereof on
filed in the office of the County Recorder, Hennepin County, Minnesota.
Adopted by the City Council on February 7, 1995.
