HomeMy WebLinkAboutCity Council Resolution 1995-091CITY OF PLYMOUTH RESOLUTION 95.91 • 1 c ,-J 1 :4 a IT II ,1'IIv z I d• I• • :� 1 • • 1 :� • / ' :r /of V • • lot 13:10100:0.1, WHEREAS, Floyd Wiivers has requested a MPUD Preliminary Pian Amendment and Conditional Use Permit for a Culver's Family Restaurant looted southwest of 34th Avenue North and Plymouth Boulevard; and WIUWJW, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, T H REFOM BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE C17Y OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Floyd Wilvers for a MPUD Preliminary Plan Amendment and Condition&: Use Permit for a Culver's Family Restaurant located southwest of 34th Avenue North and Plymouth Boulevard, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. A sidewalk shall be constructed by the developer along 34th Ave. N. 3. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, nr containing any open storm water drainage facility. 4. Submission of tequired fmancial guarantee and Site Performance Agreement for completion of site improvements within 12 months of the date of this resolution. 5. Any signage shall be in compliance with the Ordinance and approved MPUD Preliminary Plan. Specifically, a second freestanding sign for the drive through Iane is approved. 6. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 7. Compliance with the Ordinance regarding the location of fire hydrants, fire lane signage and fire lanes. Two fire hydrants are required for this site. • File 94143s Page 2 8. Compliance with Fire Division requirements regarding Post Indicator Valve and Fire Department Connection locations. 9. Compliance with Fire Division requirements regarding standard notes. 10. Compliance with Code requirements for a fie extinguishing system, 11. All waste and waste containers shall be stored in the enclosure, and no outside storage is permitted. 12. An 8 1/2 x I1 inch "As Built" Fire Protection Plan shall be submitted prier to the release or reduction of any site improvement bonds per City Policy. 13, No building pr rmit to be Issued until the Lot Division is filed and recordad with. Hennepin County. 14. A parking setback of 12 feet 6 inches is approved, 15. All building elevations shall be 100 percent brick material, excluding windows. 16, The Conditional Uso Permit is approved for a Class 11 restaurant. Adopted by the City Council on February 7, 1995, •
