WHEREAS, Three Star Trucking has requested a Preliminary Phi for Star 'Irvin
Homes Estates, a plat for 21 lots on 7.45 acres located northwest of Medina Road and
County Road 24; and
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, 1VIINNESOTA, that it should and hereby does approve
the request of Throe Star Trucking for a Preliminary Plat for 21 lots located northwest
of Medina Road and County Road 24, subject to the following conditions:
1. Compliance with the City Engineer's Memr randum.
2. Removal of all hazardous trees fro►•n the property at the owner's expense.
3. No building permits shall be issued until a contract has been awarded for sewer
and water.
4. Payment of park dedication fees in -lieu of dedication in accordance with the
Dedication Policy in effect at lite time of filing the Final Plat.
5. Street names shall comply with the City Street Naming System.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm water
drainage facility.
7. No building permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
8. Incorporation of tree protection provisions in the Final Plat and Development
Contract Approval.

9- Submittal of requited utility and drainage easements as approved by the City
Engineer prior to Kling a Final Plat.
10. No ya;d setback variances are granted or implied,
12. Compliance with the Fire Division requirements for standardized notes.
13. Submittal of a Site Improvement Performance Agreement and financial
guarantee for private improvements including landsMing.
14. Submittal of Homeowners Association Documents. The Homeowners
Association Documents for this subdivision shall include refereaoe to the
badness activities of Len Busch Roses including the use of lighting by Len
Busch Roses in the greenhouses.
