RESOLUTION NO. 93 - 89
PARTIAL RELEASE OF DEVELOPMENP CONTRACT
BASS CREEK BUSINESS PARK 3RD ADDITION
WHEREAS, the City of Plymouth and Opus Corporation entered into Development
Contract 88146 dated May 1, 1989, for the plat of Bass Lake Corporate Center First
Addition, as referenced in that certain certified copy of Resolution of the City of
Plymouth reomied in the office of the Hennepin County Recorder on May 31, 1989, as
Document No. 5539085; and
WHEREAS, The City of Plymouth, Opus Corporation, and Schneider (USA), Inc. have
WWW into that certain unrecorded Development Contract 0*1 dated June 12, 1990, for
the plat of Bass Creek Business Park Addition; and
WHEREAS, the City has been requested to grant a release of these Development
Contracts for Lot 2, Block 1, Bass Creek Business Park 3rd Addition.
NOW, MREFORII, BE IT HEREBY RESOLVE by the City Council of the City of
Plymouth;
1. With the exception of levied and pending special assessments, if any, Lot 29
Block 1, Bass Creek Business Park 3rd Addition is hereby released from the
financial obligations assumed by the Developers in conjunction with the
development of public improvements in the plats.
2. This release does not waive any fees which are required to be paid as a part of
the building permit application.
3. The Mayor and City Manager are authorized to sign the partial release.
