PLAT FOR PRIME BUIMERS FOR ( PROPERTY LOCATED AT THE SOUTHWEST CORNER OF BASS LASE ROAD AND NATHAN LANE NORT.3 (94091) WIE REAS, Prime Builders has requested a change to tlw Development Contract for Hickory Hills; and WHEREAS, the requested change would amend Item 25C the Engineer's Memorandum in the Engineer's Memo: "After the fmal plat is recorded at Kc- inepin County the following building may be constructed prior to Nathan Lane being constructed: 1, 2 and 3. A temporary cul-de-sac must be constructed along with the drive to serve these buildings. Nathan Lane must be constructed prior to building permits on Lot 1, Block 2."; and WMREAS references are made to the City Engine -'s memorandum throughout the Development Contract. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, M NNESOTA: that it should and h•,-reby does approve amending he Development Contract and Final Plat for Hickory Hills wherever reference is made to the City Engineer's memorandum dated September 10, 1994 and thereby change Item 25C as follows: "After the fuaal plat is recorded at Hennepin County the following buildu-ig may be constructed prior to Nathan Lane being constructed: 1, 2 and 3. A temporary cul-de-sac must be constructed along with the drive to serve these buildings. Building permits may be issued for Buildings 4, 5, and 20, but Nathan Lane must be constructed prior to occupancy permits being issued in Lot 1, Block 2." FURTHER, the following conditions must be sato r ted as part of the development contract amendment: 1. The rock construction entrance north of 56th Avenue and west of Nathan Lane must be properly maintained. 2. A haybale check shall be installed and maintained across the access road to direct stormwater runoff to the NURP pond. 3. The required NURP pond shat be pumped in a non-polluting manner to the nearest city catch basin when the water level reaches elevation 916. 4. A double row of silt fence, or City Engineer approved alternative, shall be installed along the wetland adjacent to building sites 18, 19, and 20. 5. A $1,000 cash deposit shall be pro%ided to the City to guarantee Items 1 - 4. If, after verbal notice has been given to the developer, or his designated representative, that a drainageleroslon control problem exists and the problem is not being repaired within 24 hours, a stop work order shall be placed on the building activity and the City will have the problem resolved using the $1,000 cash d%;posit as necessary.
