HomeMy WebLinkAboutCity Council Resolution 1995-076k CITY OF PLYMOUTH RESOLUTION NO. 95- 76 WHEREAS, the City of Plymouth has adopted an ordinance restricting the use of snowmobiles on City streets; and WHEREAS, the City has received some requests to open certain designated residential streets for snowmobile use; and WHEREAS, the City Staff proposes and City Council agrees it is advisable to adopt a process for citizens to request a residential street be approved for snowmobges. The follovring process is approved: 1. Any citizen or group of citizens requesting use of any residential street within the City of Plymouth for snowmobiles must first obtain agreement by petition of 70% of the households on the affected street. 2. The request with accompanying petition will be submitted to the Public Safety Department. 3. On April 1 of each year, or the first business day thereafter, Staff will submit all requests received to the Chair of the City's Snowmobile Task Force to set a meeting for consideration and recommendation. 4. If recommended by the Task Force, the Public Safety Department will have the request placed on a City Council agenda in June. 5. The City Council will then consider the request, petition, Task Force recommendation and staff report for approval or denial. WHEREAS, the City Council is also concerned about the location of operation and speed on any residential street. The following restrictions will apply to any approved City street: 1. Snowmobile operation is restricted to the roadway consistent with Minnesota Statute 84.81, Subd 9. "Roadway" means that portion of a (highway) City street improved, designed or ordinarily used for vehicular travel, 2. Speed is restricted to a maximum of 10 mph. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, that it designates the foregoing procedure for requesting residential roads for snowmobile use pursuant to Sectio;t 1325.03, subd 2 (a) of the City Code.
