HomeMy WebLinkAboutCity Council Resolution 1995-05811 CITY OF PLYMOUTH RESOLUTION 95-58 PARCELr TO ADJACENT PROPERTY OWN�I--� WHEREAS, Hennepin County has provided the City with a list of nonconservation properties which have become tax forfeit as a result of nonpayment of property taxes and/or special assessments; and WHEREAS, in accordance with the City Council's Tax Forfeit Land policy, each parcel has been reviewed; and WHEREAS, parcel 02-118-22-24-0040 does not serve a public purpose; and WHEREAS, the parcel is a vacant commons area for the Bass Lake Estates that the developer did not appropriately convey to the homeowners association; and i WHEREAS, the City Council is desirous of returning tax forfeit parcels to private ownership whenever possible. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Plymouth that it hereby: 1. Declares Parcel 02-118-22-24-0040 to be unbuildable from a zoning and city code perspective. 2. Authorizes the private We of said parcel to the affected homeowners association in accordance with Hennepin County procedures. 3. Requires that the homeowner association execute covenants for the parcel, confirming that the area is to be forever used by the association for commons property purposes and not development. BE IT FURTHER RESOLVED that the City Council affirms the non -conservation classification status by the Board of County Commissioners, and certifies that the parcel does not need to be withheld from sale pursuant to M.S. 85.012, M.S. 92.461, M.S. 282.01, Subd. 8, M.S. 282.018, Subd. 1, or M.S. 282.018, Subd. 2. The Council certifies that it does not know of any wells located on the property. Adopted by the City Council on January 17, 1995.
